  The paper addresses prejudicial decisions issued by consistorial courts functioning in the territory of Poland in the interwar period (1919-1939). Those decisions were made pursuant to the matrimonial law of 1836 proclaimed by tsar Nikolai I of Russia in the parts of Poland then under Russian partition to whom the Tsar granted autonomy. That law had remained in force until 1945, and pursuant to its provisions consistorial courts of certain Christian denominations enjoyed jurisdiction in matrimonial matters. Decisions of those courts were prejudicial not only in disputes relating to property and child maintenance, but also in respect of other disputes resulting from separation, divorce and annulment of marriage. The problem of the prejudicial validity of church courts appeared in the courts of interwar Poland when there a controversy arose over the settlement of child maintenance in the absence of an earlier request for separation filed with the church court. The paper discusses High Court decisions as well as law theorists' opinions issued in the 20s and 30s of the 20th century.;
  Pendant cette audience on a abordé le probleme des jugements concernant des questions prejudicielles, prononces par les tribunaux ecclesiastiques exercant une activite sur le territoire de la Pologne de l'entre deux querres, sur la base du droit matrimonial de 1836. Ce droit a ete etabli par l'empereur russe Nicolas Ier sur une partie des territoires de la Pologne d'autrefois auxquels celui-ci avait accorde l'autonomie. Ce droit a ete en vigueur jusqu'a la fin de 1945. Sur la base de cette loi, les tribunaux ecclesiastiques de certaines confessions chretiennes exercaient la juridiction en matiere matrimoniale. Les jugements de ces tribunaux etaient prejudiciels non seulement pour les litiges patrimoniaux et ceux concernants les pensions alimentaires, mais aussi pour les autres affaires resultant de la separation, du divorce ou de l'annulation de mariage. Dans la pratique judiciaire de la Pologne d'entre deux guerres a apparu un probleme relatif a la vigueur prejudicielle des jugements ecclesiastiques. Surtout la question de resoudre une affaire relative aux pensions alimentaires sans avoir entrepris une affaire en separation de faits aupres d'un tribunal ecclesiastique a souleve une vive controverse. Pendant cette audience on a presente et on a discute les decisions de la Cour Supreme concernant ce probleme et les opinions des representants de la science des lois des annees 20 et 30 du XXeme siecle.;
  Rozważania niniejsze poświęcone zostały przedsądowi konsystorskiemu w prawie województw centralnych II Rzeczypospolitej. Przedsąd konsystorski był nierozłącznie związany z jurysdykcją sądu kościelnego, stąd też jego obowiązywanie wyznaczał terytorialny oraz przedmiotowy zasięg tejże jurysdykcji. Przedsąd ten, podobnie jak przedsąd cywilny, obowiązywał na całym obszarze byłego zaboru rosyjskiego, nie był natomiast znany ustawodawstwu byłego zaboru austriackiego. Zagadnienia dotyczące obu przedsądów zostały jednak przedstawione tylko w kontekście regulacji obowiązującej w byłym Królestwie Kongresowym. Przedsąd cywilny dotyczył wprawdzie kwestii objętych jurysdykcją sądów kościelnych, stanowił jednak odrębną instytucję, dlatego został omówiony tylko w zakresie niezbędnym dla wyjaśnienia problematyki przedsądu konsystorskiego.
