  In the interwar period 1918-1939 the profession of a judge was subject to constant transformations being a result of numerous amendments to the legal regulations governing that profession. First, until 1928, the foreign laws that earlier governed in the partitioned territories of Poland had continued to apply, with only some minor modifications implemented by the Polish legislature. Later on, from 1 January 1929 and until the outbreak of the Second World War in 1939 all issues pertaining to the judicial profession were subject to common judicature uniformly applied throughout the whole country. The independence of judges was one of the main principles inherent to the profession, guaranteed by the principles providing that judges were to be appointed and when in office not subject to removal, suspension or transfer, and the office of the judge was separate and distinct from all others. During the interwar period those principles underwent certain albeit moderate modifications, especially with regard to the conduct of the traineeship, while the unification of the structure of the courts opened up the position of a judge to women, earlier unavailable to them. All those legal regulations provided for rights and duties of a judge, of which the most important rights were: the right to remuneration for the work performed, the right to retirement and pension, and the right to an annual leave. The duties, on the other hand, included: impartiality of opinion, protection of the authority of the court and avoidance of situations and any other circumstances that could be detrimental to court’s authority, the confidentiality duty and many others. Judges who additionally performed managerial functions had a special scope of duties. There were also disciplinary measures and each judge bore disciplinary liability as well. The 2nd Republic of Poland suffered from a major deficit of lawyers adequately qualified to take up a position of a judge. Consequently, those who were already appointed judges, were overloaded with work, being at the same time underpaid. Another difficulty and big problem was insufficient office space to secure proper working conditions of the judges.;
  Le métier de juge a connu pendant la période de l’ entre-deux-guerres un développement intensif. Par ailleurs, les régulations juridiques portant sur le statut de juge et sur les règles d’exercice de ce métier ont subi, dans les années 1918-1939, des changements essentiels. Jusqu’à la fin de l’année 1928, bien que modifiées par le législateur polonais, les anciennes régulations juridiques mises en place sous le Partage du pays, restent en vigueur sur le territoire durant la Deuxième République. A partir du 1er janvier 1929, une unification de la juridiction du droit commun entre en vigueur. Ainsi, jusqu’à l’éclatement de la Seconde Guerre mondiale, chaque question liée au métier de juge était régularisée globalement, pour tout le pays. Parmi les principes les plus importants concernant l’exercice des fonctions de juge, on trouve la règle d’indépendance du juge accompagnée de règles la garantissant qui étaient celle d’inamovibilité des juges, de leur non-suspension et non-mutation, la règle portant sur la distinction de leur poste ainsi que la règle de nomination des juges. En ce qui concerne les règles d’entrée en fonction, elles ont subi dans l’entre-deux-guerres certaines modifications relatives avant tout au déroulement de la formation et du stage du juge. Avec l’unification du système judiciaire, les femmes sont autorisées à exercer le métier de juge, fermé jusqu’à présent à celles-ci en Pologne. Chaque régulation juridique conférait aux juges différents droits et obligations. Les droits les plus importants étaient le droit à la rémunération du travail, le droit à la retraite et la pension et le droit aux congés. Quant aux obligations, on peut énumérer l’obligation de rester impartial pendant l’examen des affaires, l’obligation de préserver l’autorité du tribunal et d’éviter tout ce qui pourrait porter atteinte à sa dignité, l’obligation de garder le secret professionnel et bien d’autres obligations encore. Les juges occupant des postes à responsabilité au sein des tribunaux recevaient une fiche de fonction particulière. Ils encouraient une responsabilité disciplinaire pour faute de service et en cas de manquement à la dignité de leur fonctions. La Deuxième République connaît de nombreux problèmes touchant le métier de juge. Audébut, c’est lié à une énorme pénurie des gens qualifiés et à une surcharge de travail. Dansl’entre-deux-guerres, une question devient urgente, à savoir les traitements des juges considérésinsuffisants ainsi que l’absence de bonnes conditions de travail dans des locaux où les jugesdevaient exercer.
