The aim of the deliberations was to determine the scope and principles of granting public aid to support risk management in agriculture. The normative solutions contained in primary and secondary EU law have been analysed. It has been concluded that the specificity of agriculture and the accompanying risk require public support. The granting of aid should be properly shaped and stimulated. This is because of its universality and easy accessibility, which may reduce farmers’ efforts to take independent remedial measures when selecting legal risk management instruments. From an economic point of view, the granting of this aid leads to a change in the relationship between the equity and other production factors in agriculture.;
L’obiettivo delle considerazioni è di definire l’ambito e i principi di concessione di aiuti di Stato nella gestione del rischio in agricoltura. L’autrice ha analizzato le soluzioni normative contenute nella legislazione primaria e secondaria dell’UE. Nella parte conclusiva, essa ha affermato che la specificità dell’agricoltura con i rischi che comporta necessita di un sostegno pubblico. Tuttavia, la procedura di concessione di aiuti dovrebbe essere adeguatamente determinata e incentivata in quanto essi hanno un carattere universale e sono facilmente accessibili. Ciò può portare a ostacolare gli agricoltori, rendendoli meno interessati ad agire in maniera indipendente, a intraprendere contromisure volte a gestire il rischio, scegliendo strumenti giuridici adeguati. Da un punto di vista economico, fornire gli aiuti in questione porta a un cambiamento nel rapporto tra capitale in agricoltura in relazione ad altri fattori di produzione.;
Celem rozważań jest określenie zakresu i zasad udzielania pomocy publicznej w celu wspierania zarządzania ryzykiem w rolnictwie. Przeanalizowano rozwiązania normatywne zawarte w prawie pierwotnym i wtórnym UE i stwierdzono, że specyfika rolnictwa i towarzyszące mu ryzyko wymagają wsparcia publicznego. Przyznawanie pomocy powinno być jednak odpowiednio kształtowane i stymulowane. Wynika to z jego uniwersalności i dostępności, co może zmniejszyć wysiłki rolników w zakresie poszukiwania niezależnych środków i wyboru prawnych instrumentów zarządzania ryzykiem. Z ekonomicznego punktu widzenia przyznanie tej pomocy prowadzi do zmiany relacji między kapitałem własnym a innymi czynnikami produkcji w rolnictwie.
