Liability is one of the basic instruments of environmental law. The criminal liability is used for the purpose of environmental protection in order to penalize a behavior, which negatively impacts the environment and thus is considered by the legislator and the public as especially hazardous. The usefulness of this regime for the protection of the environment was noted at the EU level and consequently the directive 2008/99 on the protection of the environment through criminal law was enacted. The aim of this article is to characterize the directive 2008/99 and its implementation into Polish law.;
Odpowiedzialność prawna to jeden z podstawowych instrumentów prawa ochrony środowiska. W ramach odpowiedzialności karnej ma miejsce penalizacja zachowań polegających na oddziaływaniu na środowisko, ocenianych szczególnie negatywnie przez prawodawcę i społeczeństwo. Przydatność tego reżimu prawnego dla celów ochrony środowiska jest dostrzegana także na poziomie unijnym, co znalazło odzwierciedlenie w przyjętej dyrektywie 2008/99 w sprawie ochrony środowiska poprzez prawo karne. Celem opracowania jest charakterystyka tego aktu oraz wdrażających go przepisów prawa polskiego.
