In the article there were undertaken issues concerning legal construction of transfer of officers of other services to serve in the State Protection Service. The Act of 8 December 2017 on the State Protection Service is a comprehensive regulation of this issues. This institution makes it possible to supplement the personnel of the State Security Service with active officers of other services, without the need to conduct a qualification procedure. The initiation of this procedure, however, requires a statement from the officer about readiness to continue serving in the State Security Service. Moreover, there were discussed issues of character of this procedure and its individual stages as well as the legal consequences caused by the transfer.;
Niniejszy artykuł został poświęcony problematyce przeniesienia funkcjonariuszy innych służb do służby w Służbie Ochrony Państwa. Zagadnienie to jest uregulowane w art. 70 Ustawy z dnia 8 grudnia 2017 r. o Służbie Ochrony Państwa. Instytucja ta umożliwia uzupełnianie kadr Służby Ochrony Państwa czynnymi funkcjonariuszami innych służb bez konieczności prowadzenia wobec nich postępowania kwalifikacyjnego. Wszczęcie tej procedury wymaga jednak oświadczenia funkcjonariusza o gotowości dalszego pełnienia służby w Służbie Ochrony Państwa. Omówiono zatem problematykę odnoszącą się do charakteru tej procedury, a także poszczególnych jej etapów, jak również skutków prawnych, jakie powoduje przeniesienie.
