The Decree of the Regency Council of 31 October 1918 on the Protection of Monuments of Art and Culture was the first Polish legal regulation dedicated to the protection of monuments. This act allowed for the creation of the legal foundations necessary to build an organizational structure connected with the protection of monuments, and it also defined the framework for future protection. The decree and the historical background accompanying its adoption is discussed in detail in legal literature, but less space is devoted to the legislative history of the work on this act (pre-legislative history). It is repeatedly emphasized in the literature devoted to this subject matter that the issuance of legal regulations concerning monuments, at such an early stage of the formation of the Polish state, testifies to the importance of this topic and the visionary qualities of the contemporary political elites. Meanwhile, the adoption of the decree on the protection of monuments of art and culture was as important as other public and social matters to the decision makers of the time; consequently, the circumstances of the adoption of the decree should not be overly exaggerated.;
Dekret Rady Regencyjnej z 31 października 1918 r. o opiece nad zabytkami sztuki i kultury był pierwszą polską regulacją prawną poświęconą ochronie zabytków. Akt ten pozwolił stworzyć podstawy prawne potrzebne do zbudowania struktury organizacyjnej związanej z ochroną zabytków, a także określił ramy przyszłej ochrony. W piśmiennictwie prawniczym szczegółowo omówiono dekret oraz historyczne tło towarzyszące jego przyjęciu, ale mniej miejsca poświęcono historii legislacyjnej prac nad tym aktem (pre-legislative history). W literaturze często podkreśla się, że wydanie przepisów prawnych dotyczących zabytków na tak wczesnym etapie tworzenia się państwa polskiego świadczy o ważkości tego tematu i wizjonerstwie ówczesnych elit politycznych. Tymczasem przyjęcie dekretu o opiece nad zabytkami sztuki i kultury było dla ówczesnych decydentów równie ważne co inne sprawy publiczne i społeczne, dlatego nie należy zbyt mocno amplifikować okoliczności przyjęcia dekretu.
