  The article analyses peasant land rights during the periods of the Duchy of Warsaw and the Congress Kingdom (until the land ownership reform). The author’s interest focuses on the divided ownership. This institution of medieval origin provides for the division of the attributes of property rights between the superior owner (e.g. the landlord) and the subordinate owner (e.g. a peasant cultivating a plot of land in a landed estate). The legal status of a subordinate owner is distinguished from that of a tenant by the substantive nature of their rights. In the past, the problem of subordinate ownership in the countryside of the Duchy of Warsaw (after the December decree) and the Congress Kingdom (especially before the June ukase, i.e. edict) was sometimes considered controversial. In particular the historiography of People’s Poland questioned the existence of this institution in the analysed period. The article’s author shows that divided ownership functioned on a significant scale in the first half of the nineteenth century in the central Polish lands. At present, it is impossible to determine this scale accurately due to the limitations of current research.;
  Celem artykułu jest analiza chłopskich praw do ziemi w okresie Księstwa Warszawskiego i Królestwa Kongresowego (do uwłaszczenia). W centrum zainteresowania znajduje się własność podzielona. Ta instytucja o średniowiecznej genezie przewiduje rozdzielenie atrybutów prawa własności pomiędzy właściciela zwierzchniego (np. dziedzica dóbr ziemskich) a właściciela podległego (np. chłopa uprawiającego nadział ziemi w dobrach ziemskich). Status prawny właściciela podległego od statusy dzierżawcy (itp.) odróżnia rzeczowy charakter jego uprawnień. Problem istnienia własności podległej na wsi Księstwa Warszawskiego (po dekrecie grudniowym) i Królestwa Kongresowego (zwłaszcza przed ukazem czerwcowym) bywał w przeszłości przedmiotem kontrowersji. Zwłaszcza historiografia Polski Ludowej kwestionowała istnienie tej instytucji w interesującym nas okresie. Autor niniejszego artykułu wykazuje, że własność podzielona funkcjonowała w znacznej skali w pierwszej połowie XIX w. na centralnych ziemiach polskich, choć precyzyjne określenie tej skali na obecnym etapie badań nie jest możliwe.
