  The paper is devoted to the most problematic issues of the institution of disinheritance, both in the theoretical aspect and from the point of view of the practice of applying the law. Undoubtedly, these include the issue of the effectiveness of disinheritance and the related assessment of the relevance of analyzing the family relationship of the testator with his relatives, including the testator’s fault and his contribution to the destruction of family relations. The article focuses on a critical analysis of the existing solutions in the matter outlined, as well as de lege ferenda postulates.;
  Artykuł poświęcony jest najbardziej problematycznym zagadnieniom instytucji wydziedziczenia, zarówno na płaszczyźnie teoretycznej, jak i z punktu widzenia praktyki stosowania prawa. Niewątpliwie należą do nich kwestia skuteczności wydziedziczenia i powiązana z nią ocena relewantności analizy całokształtu relacji rodzinnych spadkodawcy z jego najbliższymi, w tym winy spadkodawcy za rozkład stosunków rodzinnych. W pracy dokonano krytycznej analizy obowiązujących rozwiązań w nakreślonej materii, jak też sformułowano postulaty de lege ferenda.
