  The aim of the article is to assess the premises justifying the exemption from inheritance and gift tax upon the acquisition of agricultural land. The hypothesis about the legislator's extra-fiscal motives determining the legal construction of the tax exemption has been positively verified as it should be so framed as to encourage taxpayers to maintain the current use of the acquired agricultural land. In particular, the subject of the analysis included issues related to the prerequisites for the application of this exemption. It has been shown that only land subject to the exemption is land acquired and forming part of an agricultural holding within the meaning of the tax legislation. The essence of the area limits included in the legal construction of the tax exemption promoting the creation of family farms has been interpreted, and reference has been made to the required period during which an agricultural holding should be run to constitute a condition for applying for the exemption and determining its amount as determined by the thresholds of de minimis aid in agriculture. In conclusion, the author states, inter alia, that only the cumulative fulfilment of all the conditions entitles the purchaser of agricultural land to the tax exemption.;
  L’articolo si propone di valutare le premesse che consentono agli acquirenti di terreni agricoli di essere esentati dall’imposta sulle successioni e donazioni. Positivamente è stata verificata un’ipotesi secondo la quale a guidare il legislatore nel determinare la strutturagiuridica dell’esenzione fiscale sono state le motivazioni extrafiscali; il che dovrebbe incoraggiare i contribuenti a voler mantenere la destinazione d’uso dei terreni agricoli acquistati. Nello specifico, l’analisi si è concentrata sui problemi legati a premesse di applicazione dell’esenzione in oggetto. È stato dimostrato che a essere soggetti all’esenzione sono soltanto i terreni facenti parte di un’azienda agricola ai sensi della normativa fiscale. Inoltre, è stata interpretata la natura dei limiti di superficie inclusi nella struttura giuridica dell’esenzione che promuove la creazione di aziende agricole a conduzione familiare; si è fatto anche riferimento a un periodo minimo di gestione di azienda agricola richiesto quale condizione di applicazione dell’esenzione e di determinazione dell’importo in base alle soglie di aiuto de minimis in agricoltura. Nella parte conclusiva, l’autore afferma, tra l’altro, che l’acquirente ha il diritto di usufruire dell’esenzione in questione solo se è in grado di adempiere a tutte le condizioni.
