  The aim of the article is to present the impact of the instruments restricting the trade in agricultural real estate introduced in the Act on shaping the agricultural system on the implementation of public purpose investments, and to evaluate, in particular in the context of the proportionality principle, the solutions adopted. To this end, the author has pointed out that the statutory regulations based on the casuistic method are not appropriate, inconsistent and raising many doubts; and has therefore proposed a solution which would uniformly, by virtue of the law itself, exclude restrictions on the acquisition of agricultural real estate for the purpose of realising public purpose investments, but would nevertheless preserve the instruments of supervision of this trade.;
  L’articolo si propone di esaminare l’impatto che gli strumenti di limitazione delle transizioni immobiliari agricole, introdotti nella legge sull’ordinamento agricolo, hanno avuto sulla possibilità di realizzare investimenti di pubblica utilità, nonché di valutare le soluzioni adottate, in particolare nel contesto del principio di proporzionalità. Nella parte conclusiva, l’autore ha messo in evidenza che le regolazioni in vigore basate su un metodo casistico nonsono adeguate, sono incoerenti e sollevano molti dubbi, e ha proposto una soluzione che escluderebbe, in maniera uniforme e in virtù della legge stessa, restrizioni all’acquisto degli immobili agricoli al fine di realizzare investimenti di pubblica utilità, mantenendo però gli strumenti di controllo di tali transizioni.;
  Celem artykułu jest przedstawienie wpływu wprowadzonych w ustawie o kształtowaniu ustroju rolnego instrumentów ograniczających obrót nieruchomościami rolnymi na realizowanie inwestycji celu publicznego i ocena przyjętych rozwiązań, zwłaszcza w kontekście zasady proporcjonalności. W konkluzji autor wskazał, że ustawowe regulacje oparte na metodzie kazuistycznej nie są właściwe, są niespójne i budzą wiele wątpliwości, oraz zaproponował rozwiązanie, które w sposób jednolity, z mocy samej ustawy, wyłączałoby ograniczenia w nabywaniu nieruchomości rolnych na potrzeby realizacji inwestycji celu publicznego, jednak z zachowaniem instrumentów nadzoru nad tym obrotem.
