The article presents the conditions that must be fulfilled so that the planned activity of a construction of the waterway connecting the Vistula Lagoon and the Gulf of Gdansk would comply with the European Union legislation on Natura 2000 protected areas. Due to the projected significant negative effects on the European ecological network, Poland will have to prove the absence of alternative solutions and imperative reasons of overriding public interest for its implementation. For this purpose, selected rulings of the European Court of Justice and the opinions of the European Commission, issued under the Habitats Directive.;
Artykuł przedstawia przesłanki, jakie powinny zostać spełnione, by planowana działalność polegająca na budowie drogi wodnej łączącej Zalew Wiślany z Zatoką Gdańską była zgodna z prawodawstwem Unii Europejskiej dotyczącym obszarów chronionych Natura 2000. Z uwagi na prognozowane znaczące negatywne oddziaływanie na unijne obszary chronione, Polska będzie musiała udowodnić brak wariantów alternatywnych oraz powody o charakterze zasadniczym, wynikające z nadrzędnego interesu publicznego, przemawiające za jej realizacją. W tym celu poddano analizie wybrane orzeczenia Trybunału Sprawiedliwości UE oraz opinie Komisji Europejskiej wydawane na podstawie Dyrektywy siedliskowej.
