  The integration between the European Union and the different national legal orders has been pursued not only through the approximation of national laws but also through the dialogue and the cooperation between jurisdictions. In particular, the achievement of the principles of direct effect and supremacy of European law have entailed, as corollary, the necessary involvement of the national jurisdictional system on the implementation of European law. At the same time, the increasing of the european substantial law has laid the problem of the harmonization of the different national procedural systems, realized through provisions with procedural contents and through the clarification of general principles concerning procedural sphere by the European Court of Justice. So, the “European law” has shaped the fundamental aspects of national justice systems: interest that receive legal protection, reliefs that can be applied, procedural principles and rules, judiciary organization. The Italian legislator, with the “Administrative trial code” has shaped the system of administrative justice to European law both through a (interpretative) generic reference to the principles of European law and through a stated reference to the European Union law and systematizing principles and institutions which come from european sphere.;

  Rozwój wspólnotowego porządku prawnego przebiegał nie tylko na drodze normatywnej, ale jest on także wynikiem współpracy poszczególnych sądów. W szczególności realizacja zasad bezpośredniego skutku i prymatu prawa unijnego wymogła na sądach krajowych aktywne uczestnictwo we wdrożeniu prawa Unii Europejskiej. Jednocześnie rozrastające się prawo materialne UE stało się źródłem problemu harmonizacji różnych krajowych systemów proceduralnych. Harmonizacja ta dokonała się za pomocą przepisów o charakterze proceduralnym oraz poprzez interpretację Trybunału Sprawiedliwości Unii Europejskiej ogólnych zasad dotyczących sfery proceduralnej. „Prawo europejskie” zatem ukształtowało podstawowe zagadnienia krajowych systemów wymiaru sprawiedliwości: interesy prawnie chronione, środki odwoławcze, przepisy i zasady proceduralne, organizacja sądownictwa. Włoski ustawodawca w niedawnej nowelizacji kodeks postępowania administracyjnego dokonał konsolidacji przepisów regulujących sądownictwo administracyjne z prawem UE, zarówno poprzez generalne odniesienie do zasad prawa Unii Europejskiej, jak i poprzez nowe uregulowanie i usystematyzowanie zasad i instytucji zaczerpniętych z prawa unijnego.
