  The aim of the study was to solve selected legal issues connected with the sale, perpetual usufruct and lease of agricultural real estate from municipal resources. The considerations involved in the first place tenders organised by municipalities for the sale and lease of agricultural real estate, the municipality's pre-emptive right, the transformation of the right of perpetual usufruct of agricultural real estate into ownership, and spatial development plans adopted by municipalities. The conclusion of the considerations is, inter alia, that the Act on the management of real estate does not provide for separate regulations that would take into account the specificity of agricultural land. As for de lege ferenda conclusions, it is proposed that reference be made to the solutions contained in the Act on the management of agricultural real estate of the State Treasury with regard to tenders organised for the sale of land and the tenants’ pre-emptive right of purchase of agricultural real estate without a tender. Moreover, it is stressed that there should be a wider consideration of the agricultural aspect in the process of adopting and amending spatial development plans.;
  L’articolo si propone di discutere di alcune questioni giuridiche scelte relative alla vendita, l’usufrutto perpetuo e l’affitto dei terreni agricoli facenti parte delle risorse comunali. Le considerazioni sono incentrate soprattutto sulle seguenti problematiche: le gare d’appalto indette dai comuni, concernenti la vendita e l’affitto dei terreni agricoli, il diritto di prelazione esercitato dal comune, il problema di convertire l’usufrutto in un diritto di proprietà, i piani regolatori approvati dai comuni. Nella parte conclusiva l’Autrice ha affermato, tra l’altro, che la legge sulla gestione immobiliare non prevede una normativa separata che tenga conto della specificità dei terreni agricoli. Se si tratta, invece, delle conclusioni de lege ferenda, ha postulato di riferirsi alle soluzioni contenute nella legge sulla gestione dei terreni agricoli Tesoro di Stato per quanto riguarda sia le gare d’appalto riguardanti la vendita dei fondi sia il diritto di prelazione nell’acquistare i terreni agricoli da parte degli affittuari senza organizzare gare. L’Autrice ha inoltre messo in evidenza che nel processo di approvare e modificare il piano regolatore bisogna tenere maggiormente conto dell’aspetto agrario.;
  Celem rozważań jest rozstrzygnięcie wybranych problemów prawnych związanych ze sprzedażą, użytkowaniem wieczystym i dzierżawą nieruchomości rolnych z zasobu gminnego. Rozważania koncentrują się na przetargach organizowanych przez gminy na sprzedaż oraz dzierżawę nieruchomości rolnych, prawie pierwokupu gminy, przekształcaniu prawa użytkowania wieczystego nieruchomości rolnych we własność, planach zagospodarowania przestrzennego uchwalanych przez gminy. W konkluzji stwierdzono, że ustawa o gospodarce nieruchomościami nie przewiduje odrębnych regulacji uwzględniających specyfikę gruntów rolnych. Jeśli chodzi o wnioski de lege ferenda, nawiązano do rozwiązań zawartych w ustawie o gospodarowaniu nieruchomościami rolnymi Skarbu Państwa w zakresie przetargów organizowanych na sprzedaż gruntów oraz prawa pierwszeństwa nabycia nieruchomości rolnych bez przetargu przez dzierżawców. Podkreślono też, że aspekt rolny powinien być szerzej uwzględniony w procesie uchwalania i zmian planu zagospodarowania przestrzennego.
