The employer is not always the perpetrator of mobbing. The employer’s responsibility for the actions of other people results from the employer’s breach of the obligationto counter mobbing (Article 943 § 1 of the Labour Code). Certainly, mobbing is a negative, undesirable phenomenon, and the interpretation of regulations shaping the employer’s responsibility for the effects of mobbing should take into account the aim of completely eliminating this phenomenon from the work environment. Precisely because of this aim, it is vital to discuss in broader terms, from the perspective of art. 943 of the Labor Code, the position expressed by the European Court of Human Rights in the justification of the judgment of November 6, 2018 (Vicent Del Campo v. Spain, no. 25527/13), which emphasized that the personal data of an employee who was not a party to court proceedings, with the indication that this employee committed acts of psychological harassment of another employee, constitutes a violation of the right of the perpetrator of these acts to respect his private life.;
L’employeur lui-même ne sera pas toujours l’auteur du harcèlement professionnel. La responsabilité de l’employeur des actions d’autres personnes résulte de ce que l’employeur enfreint l’obligation de lutter contre le harcèlement professionnel (art. 943 § 1 du code de travail). En toute certitude, le harcèlement professionnel est un phénomène négatif, indésirable, et l’interprétation du règlement formant la responsabilité de l’employeur des conséquences du harcèlement professionnel devrait prendre en considération le but, c’est-à-dire l’élimination complète de ce phénomène au milieu de travail. C’est justement eu égard à ce but qu’il faut reconnaître comme importante et exigeant une analyse plus vaste à travers le prisme de l’article 943 du Code de travail l’opinion exprimée par la Cour européenne des droits de l’homme dans les attendus du jugement du 6 novembre 2018 (Vincent Del Campo contre l’Espagne, plainte numéro 25527/13), où l’on a souligné que la mention des données personnelles de l’employé dans l’arrêt de la cour ‒ qui était étranger à la procédure ‒ en indiquant que cet employé a commis des faits constituant le harcèlement psychique d’un autre employé, constitue l’atteinte au droit de l’auteur de ces faits au respect de son intimité.;
Sprawcą mobbingu nie zawsze będzie sam pracodawca. Odpowiedzialność pracodawcy za działania innych osób wynika z naruszenia przez pracodawcę obowiązku przeciwdziałania mobbingowi (art. 943 § 1 k.p.). Z całą pewnością mobbing jest zjawiskiem negatywnym, niepożądanym, a interpretacja przepisów kształtujących odpowiedzialność pracodawcy za skutki mobbingu powinna uwzględniać cel, jakim jest całkowite wyeliminowanie tego zjawiska ze środowiska pracy. Właśnie z uwagi na ów cel, za istotne i wymagające szerszego omówienia przez pryzmat art. 943 k.p., należy uznać stanowisko wyrażone przez Europejski Trybunał Praw Człowieka w uzasadnieniu wyroku z dnia 6 listopada 2018 r. (Vicent Del Campo przeciwko Hiszpanii, skarga nr 25527/13), w którym podkreślono, że podanie w wyroku sądowym danych osobowych pracownika, który nie był stroną postępowania, ze wskazaniem, iż pracownik ten dopuścił się czynów stanowiących nękanie psychiczne innego pracownika, stanowi naruszenie prawa sprawcy tychże czynów do poszanowania jego życia prywatnego.
