  The husband’s rights as the owner of the dowry, due to its very nature, have always been subject to different limitations. One of the earliest restrictions put on husbands’ ownership rights was the prohibition to sell or otherwise dispose of a land constituting part of the dowry. The paper is an attempt to establish the contents of the prohibition of the alienation of dowry introduced by lex Iulia de fundo dotali 18 years BC. The analysis of source materials shows that lex Iulia de fundo dotali conditioned the alienation of dowry land on the express consent given by the wife. Originally, the prohibition was formulated with regard to Italian estates because when lex Iulia was enacted those provinces enjoyed considerable jurisdictional freedom enabling them to use and apply local laws. Subsequent judicial interpretations extended the binding force of that prohibition onto provincial property as well, and ensured its applicability as long as the dotis causa remained outside the wife’s property. The prohibition remained valid during the course of marriage as well as upon its termination, until all property issues between the spouses had been settled (except in situations when the marriage terminated upon the wife’s death). Similarly, it was also binding before marriage, where the husband had acquired ownership of the property dotis causa before the marriage was concluded. The prohibition applied both to ius civile and ius honorarium. It comprised all the acts that were dependent upon the will of the husband as the owner of the dowry, i.e. the actions or inactions in consequence of which the dowry would pass hands. As such, the prohibition was inapplicable in cases that were independent of the husband’s will, or which resulted in universal succession, or constituted public legal sanctions. This would happen in specific cases when the husband (i) became a subject of capitis deminutio maxima which naturally terminated the marriage and gave the wife a right to claim the dowry back, or (ii) had a sanction imposed upon him by the public authority (missio in possessionem), in which case the loss of property by the husband ought not to have a negative impact on the wife’s situation. Hence, the principle of lex Iulia de fundo dotali which applies to the new owner of the dowry land as well. The prohibition of alienation of dowry land seemed to be the most efficient way of protecting the dowry ownership and was, at the same time, one of the ways of protecting a woman in the course of marriage, possibly securing her right to recover the dowry as soluto matrimonio.;
  Les droits du mari en tant que le propriétaire des biens dotaux étaient limités dans la façon différente en considération de la nature de la dot. C’est l’interdiction de l’aliénation des immeubles dotaux qui constitua l’un de ces limites les plus anciennes. Cette interdiction fut introduite par la lex Julia de fundo dotali de l’an 18 a. J. Ch. L’article s’occupe de l’analyse du contenu juridique de cette interdiction. Selon la lex Julia de fundo dotali la possibilité de l’aliénation des immeubles dotaux dépendaient de l’accord expressif de l’épouse. A l’origine, l’interdiction de l’aliénation des biens dotaux par le mari ne concernait que l’Italie. A cette époque les provinces juissaient la liberté de juridiction bien large en ayant employé les droits de pays. Plus tard, cet état des choses s’est changé. Par la voie de l’interprétation les juristes romains ont élargi cette interdiction sur les immeubles provinciaux. Cette interdiction resta en viguer quand l’immeuble donné se trouvait en dehors des biens de femme. Il concernait la période du mariage, ainsi qu’il restait obligatoire aussi après la résiliation du lien nuptial jusqu’au moment lorsque les rapports pécuniaires entre anciens époux étaient reglés définitivement. La résiliation du mariage résultant de la mort de la femme créait une exception. Pareillement, l’interdiction d’aliénation obligerait aussi avant le mariage, si le futur mari acquérait la propriété de l’immeuble dotis causa. L’interdiction concerna le ius civile et le ius honorarium. Il porta sur tous les actes du mari en tant que le propriétaire de la dot dépendants de sa volonté en résultat desquels les immeubles dotaux pouvaient passer à la fortune d’un tiers. Cela signifiait que l’interdiction ne concerna pas les faits indépendants de la volonté du mari, en résultat desquels il arriverait à la succession universelle ou ils constituaient les sanctions du droit public. En première place, il s’agissait de la capitis deminutio maxima (la mort ou l’entrée en esclavage), ce qui faisait la résiliation du mariage et actualisait la créance de la femme pour récupérer la dot. Dans le cas deuxième, il s’agissait des situations quand le mari subissait les sanctions imposées par l’autorité publique (missio in possesionem, la confiscation). La perte des biens par le mari ne diminuait pas les intérêts de la femme. D’après la lex Iulia de fundo dotali, aussi le propriétaire nouveau devait observer l’interdiction de l’aliénation. Comme le moyen efficace de la protection de la valeur de la dot, l’interdiction en question n’était pas seulement un moyen de la protection de la position de la femme pendant le mariage, mais aussi elle facilitait la récupération de la dot soluto matrimonio.;

Uwarunkowania te oznaczały głównie ograniczenia, z których jednym z najwcześniej wprowadzonych był zakaz zbywania nieruchomości wchodzących w skład posagu. Wprowadziła go lex Iulia de fundo dotali, przy czym w doktrynie dominuje pogląd uznający tę regulację za część lex Iulia de adulteriis uchwalonej za czasów cesarza Augusta w 18 roku przed Chr. W niniejszym tekście podjęto próbę przybliżenia postanowień tej ustawy. Nie będzie on podejmował zagadnienia skutków prawnych złamania tego zakazu, jak również problemu jej rozciągnięcia na możliwość obciążenia nieruchomości posagowych.
