The aim of this article was to answer the question whether and to what extent the amendments to the legal organisation of the milk and milk products market introduced as of 1 January 2018 contribute to improving the lives of milk producers and the development of the market. This refers to certain legal solutions adopted by the EU legislator which aim to strengthen the role of agricultural producers and their organisations in the agri-food supply chain. The amendments to Regulation 1308/2013 have not changed the organisational framework of the market, but addressed basically two issues – the obligation to conclude raw milk delivery contracts and contractual negotiations in this sector. The legal solutions adopted by the legislator are very positive. Written contracts, which are mandatory in many Member States, define and guarantee the producers’ rights and clearly indicate the obligations associated with the production process. In turn, entrusting the role of a negotiator of contract terms to producers’ representatives should be seen as recognition of their significant role in shaping the market in a manner adequate to its needs.;
L’articolo si propone di rispondere alla domanda se e in quale misura le modifiche introdotte con la data del 1° gennaio 2018 riguardo l’organizzazione giuridica del mercato del latte e dei suoi prodotti di trasformazione contribuiscano a migliorare la situazione dei produttori di latte e allo sviluppo del mercato. Si tratta di alcune soluzioni giuridiche adottate dal legislatore dell’UE, volte a rafforzare il ruolo dei produttori agricoli e delle loro organizzazioni nella filiera agroalimentare. I cambiamenti apportati al regolamento 1308/2013 non vanno a modificare l’organizzazione del mercato, ma riguardano soprattutto due questioni: rendono obbligatori il ricorso ai contratti per la consegna di latte crudo nonché le trattative contrattuali. Le soluzioni giuridiche adottate dal legislatore dovrebbero essere valutate molto positivamente. Un contratto scritto, d’obbligo in molti Stati membri, definisce e garantisce i diritti del produttore, oltre a determinare chiaramente gli obblighi legati al processo di produzione. Inoltre, il ruolo del negoziatore delle condizioni contrattuali affidato ai rappresentanti dei produttori testimonia di un riconoscimento del loro significativo ruolo nel plasmare il mercato, a seconda delle esigenze dello stesso.
