  After the end of the First World War it was necessary to pass new laws that would govern in the 2nd Republic of Poland. One of the relatively important issues that needed to be addressed was Polish citizenship. The first part of the paper focuses on the main legal acts that regulated Polish citizenship between 1918 and 1939, with special focus on the Act of 1920 on the Citizenship of the Polish State. The outbreak of the Second World War in 1939 changed the geopolitical situation of Poland. However, despite the personal changes in the head state authorities, and the fact that they functioned in very specific conditions, in exile, Polish legislation continued to remain in force. This situation continued throughout the whole period of the Second World War and the Polish authorities in exile regularly referred to the existing regulations, amending them from time to time. One kind of the amended laws were those governing Polish citizenship. The author analyses the circumstances in which the Act on the Revocation of Polish Citizenship of 1938 was repealed by the Polish President in exile in 1941. Further, the main arguments raised in debates on the executive regulation to that Act held by the Second National Council of the Republic of Poland in 1942 and at intra-ministerial sittings in 1944 are presented. The paper also describes the legal position of Poles serving in allied forces, which could in consequence lead to their losing Polish citizenship. Based on the available source material, the methods used by state organs when granting, revoking and restoring Polish citizenship during the Second World War are also analysed.;
  L’article est consacré aux régulations concernant l’octroi, la déchéance et la restitution de la nationalité polonaise pendant la Seconde Guerre mondiale. De tous les aspects de ce sujet compliqué, l’Auteur choisit le fondement juridique et le processus de la décision des organes de l’état d’émigration. La création de la Deuxième République demandait l’institution de nombreuses régulations juridiques. L’une des questions essentielles qu’il fallait absolument normaliser à l’époque, était la nationalité polonaise car à chaque fois, de son octroi, de sa restitution ou de sa déchéance découlaient certains droits et obligations. Dans la première partie, on trouve la présentation des actes juridiques essentiels pour l’entre-deux-guerres, restant en rapport avec la nationalité, par exemple : « La loi sur la nationalité de l’État polonais » de 1920. L’éclatement de la Seconde Guerre mondiale a changé toute la situation géopolitique de la Pologne. Malgré des changements personnels qui touchent les pouvoirs suprêmes publics, la législation polonaise reste toujours en vigueur, mais elle est appliquée dans des conditions d’émigration spécifiques. On ne l’oublie pas pendant toute la Seconde Guerre mondiale, alors les organes publics procèdent aux modifications systématiques de la législation polonaise, dont les actes juridiques portant sur la nationalité. Dans le document analysé, sont présentées également les circonstances accompagnant l’annulation de la Loi sur la déchéance de la nationalité polonaise de 1938, sur la base du décret du Président de 1941 ainsi que le débat sur le règlement d’application en rapport avec ce décret, tenu dans le cadre du Deuxième Conseil National (1942) et pendant les délibérations interministérielles (1944). Est également abordée la situation juridique des Polonais étant sous les drapeaux des Alliés et, de ce fait, une éventuelle perte de leur nationalité. En outre, sur la base des sources préservées, les méthodes pratiquées par les organes publics pour l’octroi, la restitution et la déchéance de la nationalité pendant la Seconde Guerre mondiale ont pu être analysées.
