  Lenin believed that after the proletarian revolution, the state and the law would disappear. In the interim, there would be a dictatorship of the proletariat. With two decrees (No. 1 and No. 3 ‘On the Court’) of 1917 and 1918, the Bolshevik authorities proclaimed that all previous law had ceased to exist. They proceeded to create a new law. The new law in the Bolshevik state was to be completely different from that in the bourgeois states. This applied to constitutional law as well as civil law, criminal law and all other branches of law. The author deals with criminal law, as this played a special role during the post-revolutionary civil war period (1917–1921/22). The Bolsheviks introduced a reign of terror from the beginning. Officially, terror was initiated by the decree of 5 September 1918 ‘On Red Terror’. The institution implementing the terror was the Security Service, already established in December 1917, at the head of which Lenin placed a Bolshevik of Polish origin, Felix Dzerzhinsky.;
  Lenin uważał, że po rewolucji proletariackiej państwo i prawo znikną. W okresie przejściowym będzie istniała dyktatura proletariatu. Dwoma dekretami (nr 1 i nr 3 „o sądzie”) z 1917 i 1918 r. władze bolszewickie proklamowały, że całe dotychczasowe prawo przestaje istnieć. Przystąpiły do tworzenia nowego prawa. Nowe prawo w państwie bolszewików miało być zupełnie inne niż w państwach burżuazyjnych. Dotyczyło to zarówno prawa konstytucyjnego, jak i prawa cywilnego, karnego i wszelkich innych gałęzi prawa. Autor zajął się prawem karnym, gdyż w okresie wojny domowej po rewolucji (1917–1921/22) odegrało ono szczególną rolę. Bolszewicy od początku wprowadzili rządy terroru. Oficjalnie terror został zapoczątkowany dekretem z dnia 5 września 1918 r. „o czerwonym terrorze”. Instytucją realizującą terror była ustanowiona już w grudniu 1917 r. bezpieka, na czele której Lenin postawił bolszewika polskiego pochodzenia Feliksa Dzierżyńskiego.
