  Environmental protection is one of the most important challenges facing public administration, as part of civilization progress. This progres sometimes forces exceeding environmental quality standards, which has an impact on property rights. The key instrument which public administration controls the impact of some projects on the environment and property rights is the area of limited usufruct. The legal effect of its introduction is to limit the use of real estate. These restrictions are compensated by creating appropriate legal instruments to compensate the owner for the damage suffered. However, the mechanism of their action and the conditions for use require in-depth analysis.;
  Ochrona środowiska to jedno z ważniejszych wyzwań, jakie w obliczu postępu cywilizacyjnego stoją przed administracją publiczną. Postęp ten wymusza niekiedy przekraczanie standardów jakości środowiska, co nie pozostaje bez wpływu na prawo własności. Kluczowym instrumentem, za pomocą którego administracja publiczna kontroluje wpływ pewnych przedsięwzięć na środowisko i prawo własności, jest obszar ograniczonego użytkowania. Skutkiem prawnym jego ustanowienia jest ograniczenie sposobu korzystania z nieruchomości. Ograniczenia te rekompensowane są przez stworzenie odpowiednich instrumentów prawnych, mających wyrównać właścicielowi doznany uszczerbek. Mechanizm ich działania oraz przesłanki zastosowania wymagają jednak dogłębnej analizy.
