The paper analyses the admissibility of the right to counsel of the accused in the English criminal trial, and focuses on the pre-trial stage and the main criminal proceedings in the 13th and 14th centuries. Although the pre-trial proceedings had not been formalised until the mid 16th century, there are still some data available on which an opinion may be based. The author's focus of attention is the main criminal proceeding and the admissibility of the right to counsel at that stage, for which the sources of information seem more reliable. As can be deduced, the right to counsel depended on the form in which the criminal proceeding commenced and the weight, or gravity of the crime. In most serious cases the right to counsel was restricted. However, it was probably not until the Tudor period when the rule against defence counsel considerably toughened. This is further evidenced by instances occurring between 1300 and 1500 in which legal aid was extended in cases tried on indictment. An exception were matters initiated by private accusation, so called appeal of felony, and offences of lesser gravity, called misdemeanours. Legal issues that emerged during a criminal trial were also capable of justifying the right to counsel.;
Même si jusqu'à la moitié du XVIe siècle la procédure préjudiciaire n'a pas de cadre formel, les sources concernant cette étape du procès permettent de trouver des informations ayant une importance pour la problématique étudiée. Toutefois, seules les sources qui se réfèrent à la procédure judiciaire admettent les conclusions plus osées concernant les possibilités que pouvait avoir un accusé de bénéficier d'une aide juridique. La forme dont la procédure pénale est mise en place ainsi que l'importance du fait reproché seront essentielles dans la détermination de la recevabilité d'aide juridique accordée à un inculpé dans une procédure judiciaire. Dans les affaires pénales les plus graves, l'aide de défendeur est limitée, même si c'est probablement seul à l'époque des Tudor que the rule against defense counsel s'est sérieusement aggravé. On le voit bien des cas où l'aide juridique est octroyée dans les affaires initiées par un indictment, durant les années 1300-1500. Une percée dans la pratique interdisant l'aide de défendeur restait les affaires intentées par voie d'une plainte déposée par un particulier (appeal of felony) ainsi que les affaires de moindre importance, classées dans la catégorie misdemeanors. Par ailleurs, les questions juridiques ayant surgi en cours du procès, pouvaient également justifier l'aide de juriste apportée à l'accusé.
