In der polnischen Literatur war die Frage des illegalen Lebensmittelhandels weder aus der Sicht eines Agrarjuristen noch eines Internationalisten Gegenstand von Überlegungen. Um diese Lücke zu schließen, hat sich der Autor dieses Artikels zum Ziel gesetzt, Mechanismen zur Bekämpfung des illegalen Lebensmittelhandels im System des Völkerrechts zu identifizieren und diese Mechanismen hinsichtlich ihrer Wirksamkeit zu bewerten. Daher führte er eine Analyse internationaler Rechtsnormen im Bereich des illegalen Lebensmittelhandels durch. Es erwies sich als wichtig, den Begriff des illegalen Lebensmittelhandels, einschließlich Lebensmittelverfälschung, zu definieren. Der Autor kam zu dem Schluss, dass es im System des Völkerrechts keine geeigneten Rechtsnormen gibt, die sich explizit auf die Bekämpfung des illegalen Lebensmittelhandels beziehen. Dies liegt daran, dass es im Völkerrecht keine gesetzliche Definition dieses Phänomens gibt, abgesehen von dem Begriff des Lebensmittelbetrugs, der im Richtlinienentwurf der Codex-Alimentarius-Kommission vorgeschlagen wird. Die im Rahmen der WTO bestehenden Mechanismen sollten im Hinblick auf die Bekämpfung des illegalen Handels als unzureichend angesehen werden. Zu den wirksamen Instrumenten gehören Institutionen, Vorschriften und Verfahren, die auf das internationale Strafrecht anwendbar sind.;
This article aims to identify the mechanisms for preventing illegal food trade that are available under the international public law system, and it assesses their effectiveness. In this context, it was important to define the concept of illegal food trade, including food adulteration. In the author’s opinion, there are no international law regulations that explicitly address the prevention of illegal food trade, nor is there a legal definition of this phenomenon other than the concept of food adulteration proposed in the draft guidelines of the Codex Alimentarius Commission. The author further argues that the mechanisms existing within the WTO are inadequate for combatting illegal trade, whereas the effective instruments seem to be those institutions, regulations and procedures that are specific to international criminal law.;
En la literatura polaca, la cuestión del comercio ilegal de alimentos no ha sido objeto de consideraciones tanto desde la perspectiva de un abogado agrario como de un internacionalista. Por lo tanto, con la intención de llenar este vacío, el autor de este artículo se propuso identificar mecanismos para contrarrestar el comercio ilegal de alimentos en el sistema de derecho internacional público y evaluar estos mecanismos en términos de su efectividad. Por ello, emprendió un análisis de los estándares legales internacionales en el ámbito del comercio ilegal de alimentos. Resultó importante definir el concepto de comercio ilegal de alimentos, incluida la adulteración de alimentos. El autor llegó a la conclusión de que en el sistema del derecho internacional no existen normas jurídicas apropiadas que se relacionen explícitamente con la lucha contra el comercio ilegal de alimentos. Esto se debe a que no existe una definición legal de este fenómeno en el derecho internacional, aparte del concepto de fraude alimentario propuesto en el proyecto de directrices de la Comisión del Codex Alimentarius. Los mecanismos existentes en el seno de la OMC deberían considerarse insuficientes desde el punto de vista de la lucha contra el comercio ilícito. Los instrumentos eficaces incluirían instituciones, reglamentos y procedimientos aplicables al derecho penal internacional.;
Nella letteratura polacca, la questione del commercio illegale di prodotti alimentari non è stata oggetto di considerazioni né dal punto di vista di un avvocato agrario né da quello di un internazionalista. Pertanto, con l'intenzione di colmare questa lacuna, l'autore di questo articolo si è posto l'obiettivo di identificare meccanismi per contrastare il commercio alimentare illegale nel sistema di diritto internazionale pubblico e di valutare questi meccanismi in termini di efficacia. Pertanto, ha intrapreso un'analisi degli standard giuridici internazionali nel campo del commercio alimentare illegale. Si è rivelato importante definire il concetto di commercio alimentare illegale, inclusa l’adulterazione alimentare. L'autore è giunto alla conclusione che nel sistema del diritto internazionale non esistono norme giuridiche adeguate che si riferiscano esplicitamente alla lotta al commercio illegale di prodotti alimentari. Ciò è dovuto al fatto che non esiste una definizione giuridica di questo fenomeno nel diritto internazionale, a parte il concetto di frode alimentare proposto nella bozza delle linee guida della Commissione Codex Alimentarius. I meccanismi esistenti in seno all'OMC dovrebbero essere considerati insufficienti dal punto di vista della lotta al commercio illecito. Strumenti efficaci includerebbero istituzioni, regolamenti e procedure applicabili al diritto penale internazionale.;
Celem artykułu jest wskazanie mechanizmów przeciwdziałania nielegalnemu obrotowi żywnością w systemie prawa międzynarodowego publicznego oraz ocena ich efektywności. Istotne okazało się przy tym określenie pojęcia nielegalnego obrotu żywnością, w tym fałszowania żywności. Autor doszedł do wniosku, że w systemie prawa międzynarodowego nie występują regulacje odnoszące się explicite do przeciwdziałania nielegalnemu obrotowi żywnością, brakuje legalnej definicji tego zjawiska poza proponowanym w projekcie wskazówek Komisji Codex Alimentarius pojęciem fałszowania żywności. Zdaniem Autora istniejące w ramach WTO mechanizmy należy uznać za niewystarczające do przeciwdziałania nielegalnemu obrotowi. Natomiast do efektywnych instrumentów można zaliczyć instytucje, regulacje i procedury właściwe dla międzynarodowego prawa karnego.
