  Glosa krytyczna do wyroku Sądu Najwyższego, który w uzasadnieniu swojego orzeczenia wyraził  pogląd, że stan po użyciu środka podobnie działającego do alkoholu jest równoznaczny ze znajdowaniem się tego środka w organizmie. Autor glosy krytycznie podszedł też do tezy, że użycie środka odurzającego nie oznacza jeszcze realnego wpływu zażytego środka na zdolności psychomotoryczne kierowcy
