  The Polish Senate’s electoral system is based on the majority formula for 33 years. The Electoral Code introduced a new element – single-member constituencies, which, in combination with the relative majority, imply the danger of omitting significant part of votes and the threat of winning by candidates with no majority support. The postulate of an absolute majority with the possibility of a second round of voting seems to be a solution supporting chamber’s representativeness and accepted in doctrine. The author also examines the last three elections in terms of the influence of the required majority on their results. The conclusions confirm the legitimacy of the formulated postulate and indicate the need of comprehensive reform of the Senate’s electoral system.;
  System wyborczy do Senatu RP był modyfikowany w ostatnich 33 latach już trzykrotnie. Wszystkie dotychczas obowiązujące ordynacje opierały się na założeniu formuły większościowej. Obowiązujący od 2011 roku Kodeks Wyborczy wprowadził jednak element zupełnie nowy – jednomandatowe okręgi wyborcze, które w połączeniu z formułą większości względnej implikują niebezpieczeństwo pomijania głosów części społeczeństwa oraz zagrożenie obejmowania mandatów przez kandydatów niecieszących się poparciem większości wyborców okręgu. Formułowany postulat wprowadzenia zasady bezwzględnej większości głosów z ewentualnością przeprowadzania drugiej tury głosowania wydaje się być rozwiązaniem sprzyjającym reprezentatywności przedstawicielskiego organu kolegialnego oraz akceptowanym w doktrynie. Autor analizuje ostatnie trzy elekcje pod kątem wpływu wymaganej większości na wyniki wyborów. Wnioski płynące z badania stanowią potwierdzenie zasadności formułowanego postulatu oraz wskazują potrzebę całościowej reformy systemu wyborczego do Senatu RP.
