Litigation of consumer disputes before state court, with its commonly known disadvantages, is inefficient. At the same time, arbitration developed intensively in the last couple of years. Arbitration, in contradiction to litigation, has a number of advantages. Question arises therefore, if arbitration – in particular class action arbitration – can replace litigation as a preferred mechanism of resolving consumer disputes. This article, while answering to this question, is a voice in the debate of the future of class action arbitration as a efficient mechanism of resolving consumer disputes.;
Powszechnie znane mankamenty postępowania przed sądem powszechnym powodują, że podstawowy sposób dochodzenia przez konsumentów swoich roszczeń, zakładający wniesienie sprawy do sądu powszechnego i rozpoznanie jej w trybie procesu, jest nieskuteczny. Jednocześnie kilkanaście ostatnich lat to intensywny rozwój sądownictwa polubownego, które cechuje się szeregiem zalet i stanowi swego rodzaju przeciwieństwo sądownictwa powszechnego. Powstaje zatem pytanie, czy arbitraż, a w szczególności grupowe postępowanie arbitrażowe (class action arbitration), może zastąpić sądownictwo powszechne jako preferowany mechanizm rozstrzygania sporów konsumenckich. Niniejszy artykuł, próbujący udzielić odpowiedzi na to pytanie, jest głosem w dyskusji co do przyszłości instytucji class action arbitration jako skutecznego mechanizmu dochodzenia przez konsumentów swoich roszczeń.
