  In the gloss the author analyzes a juridical nature of the claims of a guarantor against a mandator in a contract of guarantee. The claims may arise both ex lege (according to Article 742 of the Polish civil code) and ex contractu – from the provisions of a mandate contract. The author shares an opinion of the judiciary (Supreme Court), that the claims cannot be undermined by pleas arising from a primary (principal) contract.;
  W glosie autor analizuje charakter prawny roszczenia gwaranta wobec zlecającego po wykonaniu obowiązku gwarancyjnego. Roszczenie to może wynikać ex lege (art. 742 k.c.) lub z postanowień umowy zlecenia. Autor podziela stanowisko sądu, że roszczenia takie mogą być w zasadzie podważone jedynie zarzutami wynikającymi ze stosunku zlecenia łączącego zlecającego z beneficjentem gwarancji (stosunku podstawowego).
