The article aims to resolve the issue of whether the death of a participant in land and mortgage register proceedings, whose right is to be entered or removed from the register, has an impact on the rapid and efficient disclosure of a change in the legal status of real estate in the land and mortgage register. In particular, it clarifies whether this state of affairs results in the suspension of these proceedings and then in their resumption with the participation of their legal successors under the regulations of the Polish Code of Civil Procedure. The author, using the dogmatic-legal method, examines the regulation of the institution of land and mortgage registers, and the associated proceedings, in the light of the issue at hand. In addition, he analyses the jurisprudence of the European Court of Human Rights, the Constitutional Tribunal, and the Supreme Court focused on the issue in question. The article determines that in terms of ensuring that participants in the legal turnover of real estate have their rights protected, the land and mortgage register court is not obliged to suspend land and mortgage register proceedings in the event of the death of a participant in these proceedings in order to undertake them with the participation of his or her legal successors, as this is in conflict with the rapid and efficient disclosure of the change in the legal status of the real estate in the land and mortgage register.;
Celem artykułu jest rozstrzygnięcie kwestii, czy śmierć uczestnika postępowania wieczystoksięgowego, którego prawo ma być wpisane bądź wykreślone, ma wpływ na szybkie i sprawne ujawnienie w księdze wieczystej zmiany stanu prawnego nieruchomości. W szczególności ustalenia wymaga, czy ten stan skutkuje – na podstawie art. 174 § 1 pkt 1 w zw. z art. 13 § 2 k.p.c. – zawieszeniem tego postępowania, a następnie podjęciem go z udziałem następców prawnych zgodnie z art. 180 § 1 pkt 1 w zw. z art. 13 § 2 k.p.c. Wykorzystując metodę dogmatycznoprawną, wnikliwe zbadano regulacje instytucji ksiąg wieczystych i postępowania wieczystoksięgowego istotnych z punktu widzenia omawianego zagadnienia. Dodatkowo analizie poddano orzecznictwa Europejskiego Trybunału Praw Człowieka, Trybunału Konstytucyjnego oraz Sądu Najwyższego dotyczące powyższych kwestii. Wnioski z przeprowadzonej analizy przesądzają o tym, że – z punktu widzenia zapewniania uczestnikom obrotu prawnego nieruchomościami ochrony ich praw – sąd wieczystoksięgowy nie ma obowiązku zawieszania postępowania wieczystoksięgowego w przypadku śmierci uczestnika tego postępowania celem podjęcia go z udziałem jego następców prawnych, gdyż stoi to w sprzeczności z szybkim i sprawnym ujawnieniem w księdze wieczystej zmiany stanu prawnego nieruchomości.
