  The aim of this article is to describe the problem of waiver of legitime in the polish law. This institution is not clearly regulated in the book IV of Civil Code, hence its presence in the system of inheritance law is controversial. The author presents the formation of a waiver of legitime contract against the background of regulations before and after the entry into force the Civil Code. There are compiled opposing views on the admissibility of a waiver of legitime de lege lata. There is also analyzed waiver of a claim for legitime, existing and future. Against the background of the argument presented in the article the author expresses her own opinion, as well as formulate postulates de lege ferenda.;
  Niniejszy artykuł ma na celu przybliżenie zagadnienia zrzeczenia się zachowku w prawie polskim. Instytucja ta nie została w sposób wyraźny uregulowana w księdze I V Kodeksu cywilnego, stąd jej obecność w systemie prawa spadkowego wywołuje wiele kontrowersji. Autorka prezentuje ukształtowanie umowy zrzeczenia się zachowku na tle regulacji obowiązującej przed okresem obowiązywania przepisów Kodeksu cywilnego i po wejściu ich w życie. Zestawione zostają przeciwstawne poglądy w zakresie dopuszczalności zrzeczenia się prawa do zachowku de lege lata. Analizie podlega nadto zrzeczenie się roszczenia o zachowek istniejący oraz przyszły. Na tle przedstawionej w artykule argumentacji autorka wyraża własne stanowisko, jak również formułuje postulaty de lege ferenda.
