One of the main elements of the rehabilitation council of a local government unit is their independence. This independence is based upon creating systems, shaping financial policy tax policy, and civil law along with the capability to execute public duties. Local government must guarantee, in particular, economy, efficiency, punctuality and effectiveness of its own. The author of the article refers to the adopted doctrine, selected jurisprudence and points out the de lege ferenda assumption, the overarching goal of which is to emphasize the organization of work of the social welfare system for local government.;
Jednym z głównych elementów prawnej instytucji funkcjonowania jednostek samorządu terytorialnego jest ich samodzielność. Samodzielność ta opiera się na budowaniu ustroju wewnętrznego, kształtowaniu polityki finansowej, podatkowej, cywilnoprawnej wraz ze zdolnością do wykonywania zadań publicznych. Samorząd terytorialny musi gwarantować w szczególności gospodarność, efektywność, terminowość i skuteczność swoich działań. Autor przedmiotowego artykułu odwołuje się do przyjętych ustaleń doktrynalnych i wybranego orzecznictwa, kierując ocenę wybranych środków nadzoru na ich kształtowanie poprzez politykę administracyjną. Wskazuje również założenia de lege ferenda, których nadrzędnym celem jest zaakcentowanie istotności funkcjonującego prawnego systemu nadzoru nad samorządem terytorialnym.
