  The aim of the article is to describe the relationship between the state of being bound by an offer and the validity of a bid bond under the new Public Procurement Law. A number of research problems focus on the question of the validity of the bid bond of the selected offer. It can be deduced from the civil law, that the status of being bound by the selected offer ceases with the selection made by the contracting authority. The offer loses its legal autonomy and becomes an element of the pre-contractual relationship. This means that the statutory obligation to return the bid bond, which occurs when the offer’s validity has expired, does not apply to the selected offer. The state of being bound by the offer and the validity of the tender bond, coexisting before the selection of the offer, are separated. It allows the bid bond to fulfill its key function, which is securing a claim for the conclusion of a public procurement contract.;
  Celem artykułu jest opisanie relacji zachodzących między stanem związania ofertą a ważnością zabezpieczenia wadialnego na gruncie nowego Prawa zamówień publicznych. Szereg problemów badawczych ogniskuje się w pytaniu o ważność wadium zabezpieczającego ofertę wybraną jako najkorzystniejsza. Opierając się na regułach kodeksowych, należy uznać, że stan związania ofertą wybraną ustaje z chwilą dokonania wyboru przez zamawiającego. Oferta traci swój osobny byt prawny, przekształcając się w element stosunku przedkontraktowego. Oznacza to, że ustawowy obowiązek zwrotu wadium zachodzący w przypadku upływu terminu związania ofertą nie dotyczy oferty wybranej. Dochodzi zatem do rozdzielenia współistniejących przed wyborem stanu związania ofertą i ważności wadium. Dzięki temu wadium może wypełniać swoją kluczową funkcję, jaką jest zabezpieczenie roszczenia o zawarcie umowy w sprawie zamówienia publicznego.
