  In the commented judgment, the Administrative Court in Warsaw evaluated the possibility of applying the exemption specified in Art. 21 (1) (68) of the Personal Income Tax Act to competitions involving electronic games. The article analyses the judgment in the context of recognising a certain form of electronic gaming activity as sport within the meaning of the Sports Act. It is only when a competition is considered to be a competition in the field of sport then it is possible to apply an income tax exemption. In addition, the doubts raised by the doctrine of sports law concerning the legitimacy of including a legal definition of sport in the act have been mentioned. Finally, the consequences of recognising certain types of e-sports competition for these activities have been determined, due to the fact that they have been equated with traditional sport, the professing and organisation of which is regulated under the Sports Act.;
  W komentowanym orzeczeniu Wojewódzki Sąd Administracyjny w Warszawie rozważył możliwość zastosowania zwolnienia określonego w art. 21 ust. 1 pkt 68 ustawy podatku dochodowym od osób fizycznych w stosunku do konkursów polegających na rywalizacji w ramach gry elektronicznej. W artykule przeanalizowano orzeczenie w kontekście uznania określonej formy aktywności z zakresu gier elektronicznych jako sport w rozumieniu ustawy o sporcie. Dopiero bowiem uznanie danego konkursu za konkurs z dziedziny sportu uzasadnia możliwość zastosowania zwolnienia przedmiotowego w stosunku do podatku dochodowego. Dodatkowo, wspomniane zostały wątpliwości przedstawiane przez doktrynę prawa sportowego odnoszące się do zasadności zawierania w akcie prawnym definicji legalnej sportu. Określone zostały także skutki, z jakimi wiąże się uznanie niektórych rodzajów współzawodnictwa e-sportowego dla tych aktywności, z uwagi na zrównanie ich ze sportem tradycyjnym, którego uprawianie i organizowanie uregulowane jest w ramach ustawy o sporcie.
