The essence is the possibility of applying in this article that the main element is a feature of fraudulent practitioners, which is aimed at obtaining an inconsistent entry in the land and mortgage register of ownership of other real estate, as well as reservations about potential legal actions that are possible to apply, and aimed at restoring the status of the remains of the unlawful entry of rights to someone else’s real estate. On these cases, the authors also analyze the crime of fraud and its additional applications – judicial fraud, which is the main element necessary for the implementation of this type of unlawful activities.;
Istotą rozważań zawartych w przedmiotowym artykule jest wskazanie kluczowych cech oszukańczych praktyk, które mają na celu doprowadzenie do uzyskania niezgodnego ze stanem rzeczywistym wpisu w księdze wieczystej prawa własności do cudzej nieruchomości. W publikacji dokonano analizy obowiązującego stanu prawnego i wskazano na potencjalne działania prawne, które są możliwe do podjęcia w celu przywrócenia stanu prawnego sprzed uzyskania bezprawnego wpisu nabycia prawa do cudzej nieruchomości. Na potrzeby tych rozważań autorzy dokonali nadto karnoprawnej analizy występku oszustwa oraz jego szczególnej odmiany – oszustwa sądowego. Na ogół ten typ przestępstwa stanowi bowiem pierwszy krok sprawcy do realizacji tego rodzaju bezprawnych działań.
