  The commentary contains critical comments to the resolution of the Supreme Administrative Court of March 27, 2023 and FPS. They mainly concern discrepancies between the question posed by the ordinary panel of the Supreme Administrative Court and the content of the resolution, and the consequences of this state of affairs for practice. The second thread includes reflections on the way of understanding the concept of “administrative law” used in the provision of art. 15zzr of the COVID-19 Act.
