  The article pertains to familiarize readers with kinds of contractual clauses triggering different consequences in instance of their breach. The author begins by sketching historical evolution of the clauses in question. Specifically, she presents arguments for creation of intermediate terms in the milestone judgment Hongkong Fir Shipping Ltd v Kisen Kaisha Ltd from 1962. Subsequently she analyses recent contradicting judgments in which English courts decided upon the character of charter contract’s clauses. The author evaluates arguments in favour of different classification of the terms, most importantly the need of certainty as to possible remedies for the contractual parties, on the other hand the necessity of adequate protection as to the consequences of the breach.;
  Artykuł ma na celu zapoznanie czytelnika z rodzajami postanowień umownych wyróżnianych w prawie angielskim ze względu na konsekwencje ich naruszenia przez stronę umowy. Autorka rozpoczyna swój wywód od zarysowania historycznego rozwoju omawianych klauzul umownych. W szczególności przedstawia argumenty, które przemówiły za stworzeniem kategorii pośrednich postanowień umownych w słynnej sprawie Hongkong Fir Shipping Ltd v Kisen Kaisha Ltd z 1962 r. Następnie autorka sięga do niedawnych orzeczeń, w których sądy angielskie badały charakter postanowień umów czarteru statku, dochodząc do sprzecznych rozstrzygnięć. Ocenia argumenty przemawiające za różną klasyfikacją postanowień w tych orzeczeniach. Wśród nich na szczególną uwagę zasługuje potrzeba pewności co do przysługujących stronom praw oraz konieczność rozstrzygnięcia adekwatnego do skutków naruszenia umowy.
