  Psychiatric and psychological terminology in criminal cases in translation from Serbian into Polish

  The article discusses major Serbian and Polish terms in the area of mental health and criminal regulations applicable in situations where it is necessary to appoint an expert psychiatrist or psychologist to examine mental state of the perpetrator upon committing a crime, or one’s mental development, as well as to evaluate mental state of a witness, one’s mental capacity, perception, or ability to recall perceptions. The analysis involved excerpts from translations from Serbian into Polish of expert opinions in criminal cases and court rulings, pointing to errors made by translators, which could affect the meaning of the source text, and thus the decisions made by the procedural authorities. Pursuant to the analysis, three fundamental critical errors have been identified in translations of expert opinions, which errors can distort the meaning of the source text and lead to specific legal effects.;
  W artykule omówiono najważniejsze serbskie i polskie terminy z zakresu ochrony zdrowia psychicznego oraz przepisów karnych mających zastosowanie w sytuacji, w której konieczne jest powołanie biegłego psychiatry lub psychologa w celu zbadania stanu psychicznego sprawcy w momencie popełnienia czynu lub jego rozwoju umysłowego, jak również dokonania oceny stanu psychicznego świadka, jego zdolności umysłowych, zdolności postrzegania czy odtwarzania postrzeżeń. Analizie poddano fragmenty tłumaczeń z języka serbskiego na język polski opinii biegłych sporządzonych w sprawach karnych oraz wyroków sądów, ze wskazaniem błędów popełnionych przez tłumaczy, które mogły rzutować na znaczenie treści oryginału i tym samym decyzje podjęte przez organ procesowy. Na podstawie przeprowadzonej analizy wyodrębniono trzy zasadnicze błędy krytyczne w tłumaczeniach opinii biegłych, które mogą wypaczać sens tekstu źródłowego i wywołać określone skutki prawne.
