  The critical gloss to the judgment of the Supreme Administrative Court, which, referring to the provisions was characterised by a low level of specificity, ordered the disclosure of data protected by telecommunications secrecy for the purposes of a case of misdemeanour. The author of the gloss raises the issue important from the point of view of information security that general provisions cannot constitute a basis for interference with the secrecy of communications, which is subject to constitutional protection.;
  Glosa krytyczna do wyroku Naczelnego Sądu Administracyjnego, który odwołując się do przepisów charakteryzujących się niskim poziomem określoności, nakazał udostępnienie danych chronionych tajemnicą telekomunikacyjną na potrzeby sprawy o wykroczenie. Autor glosy podnosi istotną z punktu widzenia bezpieczeństwa informacji kwestię, że przepisy ogólne nie mogą stanowić podstawy ingerencji w tajemnicę komunikowania, która podlega konstytucyjnej ochronie.
