  The practice of reserving the right of pre-emption for the State Treasury, local government units and other entities by way of a statute should be regarded as an emanation of the State. The frequency with which this practice is exercised is Poland has been increasing at a very high rate in recent years. The statutory right of pre-emption concerning agricultural real estate, reserved for the State Treasury in the provisions of the Act of 11 April 2003 on shaping the agricultural system is of particular legal and practical significance. The subject of this article is the legal characteristics of this entitlement granted to the National Support Centre for Agriculture, and examination whether exercising this right in the State Treasury's name is arbitrary (discretionary) or whether it ought to be exercised with a view of fulfilling constitutional and statutory prerequisites of State’s interference in the ownership right. The author presents an opinion that the current statutory form and the practice of the execution of the pre-emptive right to purchase agricultural real estate by the National Support Centre for Agriculture raise serious doubts of constitutional nature. These doubts result from the lack of a clear statutory separation of the prerequisites for the application of this right granted to the State Treasury in relation to private agricultural real estate. He also proposes to determine a statutory catalogue of such premises and to establish a reliable administrative procedure where necessary, regarding State’s interference in private-legal relationships, so that decisions made by public administration are not arbitrary.;
  La prassi di riservare, per mezzo della legge, il diritto di prelazione a beneficio del Tesoro di Stato, degli enti locali ma anche di altri soggetti, percepiti come emanazione dello Stato, ha subito un intenso sviluppo negli ultimi anni in Polonia. Di particolare rilevanza giuridica e pratica risulta il diritto di prelazione circa i terreni agricoli, che, ai sensi delle disposizioni della legge dell’11 aprile 2003 sul regime agrario, spetta al Tesoro di Stato. L’articolo si propone di fornire una descrizione giuridica del diritto, di cui gode il Centro, nonché di valutare se beneficiarne per proprio conto a favore del Tesoro di Stato abbia un carattere arbitrario (discrezionale) oppure dovrebbe dipendere dai requisiti costituzionali e da quelli previsti dalla legge in materia di ingerenza dello Stato nel diritto di proprietà. L’autore è dell’opinione che, nell’attuale aspetto normativo, il diritto in oggetto nonché il suo esercizio da parte del Centro sollevano seri dubbi di natura costituzionale. Essi scaturiscono dal fatto che manchino chiari requisiti normativi riguardanti il suo esercizio nei confronti dei terreni agricoli privati da parte del Tesoro di Stato. Inoltre, si postula di definire i requisiti sopramenzionati, come anche di determinare una procedura amministrativa attendibile, che permetta di verificare se l’ingerenza da parte dello Stato nel diritto privato sia necessaria, affinché le decisioni prese dalla pubblica amministrazione non risultino arbitrarie.;
  Praktyka zastrzegania w drodze ustawy prawa pierwokupu na rzecz Skarbu Państwa, jednostek samorządu terytorialnego oraz innych podmiotów, które należy uważać za emanację państwa, podlegała w ostatnich latach w Polsce intensywnemu rozwojowi. Do kategorii o szczególnym znaczeniu prawnym i praktycznym należy zaliczyć ustawowe prawo pierwokupu nieruchomości rolnych, zastrzeżone na rzecz Skarbu Państwa w przepisach ustawy z 11 kwietnia 2003 r. o kształtowaniu ustroju rolnego. Przedmiotem artykułu jest charakterystyka prawna tego uprawnienia Krajowego Ośrodka Wsparcia Rolnictwa, w tym rozważenie, czy korzystanie z niego w imieniu własnym na rzecz Skarbu Państwa ma charakter dowolny (uznaniowy), czy powinno następować po zaistnieniu konstytucyjnych i ustawowych przesłanek państwowej ingerencji w prawo własności. Autor wyraża pogląd, że prawo pierwokupu nieruchomości rolnych w jego aktualnej ustawowej postaci oraz praktyka jego wykonywania przez Krajowy Ośrodka Wsparcia Rolnictwa budzą poważne wątpliwości natury konstytucyjnej. Wynikają one z braku wyraźnego ustawowego wyodrębnienia przesłanek stosowania tego uprawnienia Skarbu Państwa w stosunku do prywatnych nieruchomości rolnych, które pozostawałyby w merytorycznym związku z konstytucyjnymi wartościami, uzasadniającymi ograniczenie prawa własności. Postuluje również określenie ustawowego katalogu takich przesłanek oraz ustanowienie rzetelnej procedury administracyjnej w zakresie weryfikacji konieczności ingerencji państwa w stosunki prywatnoprawne, tak by rozstrzygnięcia dokonywane przez administrację publiczną nie były arbitralne.
