  The constitutional catalogue of rights and freedoms contained in Chapter II of the Constitution of the Republic of Poland – titled The Freedoms, Rights and Obligations of Persons and Citizens – must be guaranteed by the judge. The greater the need to implement the principle of a democratic constitutional state, the more attention is paid to the relationship between the independence of the judiciary and respect for human rights and freedoms. Therefore, the  administration of justice depends not only on the content of the legal solutions to the catalogue of rights and freedoms, but also on the attitude of the judge, and this attitude is subject to the influence of a certain legal culture, as well as to the modes of evaluation accepted and approved in the judicial community. Fairness must be taken into account in every act of interpretation and application of the law by the judge. This is because justice, human dignity and the good are universal  values, and this serves as an argument for them to guide the interpretation of all legal rules. Applying the law in accordance with the principles of aequitas, veritas and justitia must be the canon of the legal culture of judges, not least because a model of legal interpretation that treats the law merely as a work of thought, involving neither judgments nor values, is unreliable and can lead to illegality. That is why judicial activism is necessary.;
  Konstytucyjny katalog praw i wolności ujęty w Rozdziale II – Wolności, prawa i obowiązki człowieka i obywatela, musi być gwarantowany przez sędziego. Im silniejsza staje się konieczność realizacji zasady demokratycznego państwa prawnego, tym bardziej zwraca się uwagę na to, jakie powinny być relacje między sędziowską niezawisłością a respektowaniem praw i wolności człowieka. Dlatego wymiar sprawiedliwości uzależniony jest nie tylko od tego, jaka jest treść ustawowych rozwiązań dotyczących katalogu praw i wolności, ale także uzależniony jest od postawy sędziego, a ta postawa podlega wpływom określonej kultury prawnej, jak również przyjmowanym i aprobowanym w społeczności sędziowskiej sposobom wartościowania. Słuszność musi być uwzględniana w każdym akcie wykładni i stosowania prawa przez sędziego. Jest tak dlatego, że sprawiedliwość, godność człowieka, dobro stanowią wartości uniwersalne, a to jest argument przemawiający za tym, by kierowały interpretacją wszystkich przepisów prawnych. Stosowanie prawa zgodnie z zasadą aequitas, veritas i iustitia musi być kanonem kultury prawnej sędziów także z uwagi na to, że model wykładni prawa traktowany tylko jako praca myślowa, która nie angażuje ani ocen, ani wartości, jest zawodny i może prowadzić do bezprawia. Dlatego konieczny jest sędziowski aktywizm.
