  The aim of this paper was to analyse the main areas of contemporary legal regulation of agricultural real estate market which affect both the legal situation of the agricultural real estate owner and the contemporary shape of agricultural market. The authors conclude, among other things, that state interference, especially in the public law sphere, violates the constitutional limits of property protection as it significantly depletes the right of owner's freedom of action. The existing regulatory restrictions violate clearly the balance in the regulation of agricultural property understood as a complex of rights and obligations. The emerging normative primacy and domination of legal instruments of intervention in the agricultural real estate market available in administrative law limit the occurrence of civil law instruments in favour of administrative law instruments.;
  L’articolo si propone di sottoporre ad analisi le principali aree della regolazione giuridica in materia di trasferimento dei terreni agricoli, la quale ha un impatto sia sulla posizione giuridica del proprietario di un terreno agricolo sia sulla struttura del mercato agricolo stesso. Nella parte conclusiva, gli autori affermano, tra l’altro, che l’imperiosa ingerenza dello Stato, specie nella sfera del diritto pubblico, porta a violare i limiti costituzionali che concernono la tutela della proprietà in quanto essa mette rilevanti limiti al diritto, esercitato dal proprietario, di agire liberamente. Le restrizioni normative esistenti vanno ad alterare notevolmente l’equilibrio che caratterizza la regolazione della proprietà agricola, intesa come un insieme di diritti e doveri. Un primato normativo che sta per emergere nonché il predominio degli strumenti amministrativi di intervento nel mercato dei terreni agricoli vanno a ridurre la presenza di strumenti di diritto civile a favore di quelli di diritto amministrativo.;
  Celem rozważań jest analiza głównych obszarów współczesnej regulacji prawnej obrotu nieruchomościami rolnymi, wpływającej zarówno na sytuację prawną właściciela nieruchomości rolnej, jak i na współczesny kształt rynku rolnego.  W konkluzji autorzy stwierdzają między innymi, że władcza ingerencja państwa zwłaszcza w sferze ingerencji publicznoprawnej narusza konstytucyjne granice ochrony własności poprzez istotne uszczuplenie prawa swobody działania właściciela. Występujące ograniczenia regulacyjne wyraźnie naruszają równowagę w regulacji własności rolniczej pojmowanej jako kompleks praw i obowiązków . Tworzący się normatywny prymat i dominacja administracyjnoprawnych instrumentów interwencji w rynek nieruchomości rolnych ogranicza występowanie instrumentów cywilnoprawnych na rzecz instrumentów administracyjnoprawnych.
