The paper examines situations in which a person – either party or a third party – that was absent during civil proceedings may claim refusal of recognition or enforcement of the judgement. The analysis focuses on interpretation of regulation no. 1215/15 in respect of default judgements, proceedings in which party’s absence was a result of decision of a court, decisions regarding provisional measures and the judgements that are enforced against the people who are not mentioned in the legal title. The paper scrutinise the general rules on the subject matter that steams from the CJEU jurisprudence and invokes assessment of those mechanisms in the light of article 6 ECHR provided by ECHR.;
Celem artykułu jest ustalenie sytuacji, w których sąd może odmówić uznania lub stwierdzenia wykonalności orzeczenia wydanego w procesie cywilnym w jednym z państw członkowskich UE przeciwko podmiotowi, który nie uczestniczył w wydaniu tego orzeczenia. Przeanalizowana została dokonywana przez TSUE, ETPCz oraz sądy krajowe wykładnia przepisów rozporządzenia nr 1215/12 regulujących odmowę wykonywania orzeczeń zapadłych w sprawach toczących się bez udziału pozwanego, uczestnika oraz osoby trzeciej. Pod uwagę wzięte zostały postępowania zakończone wyrokami zaocznymi, orzeczenia wydane na skutek wykluczenia pozwanego z postępowania, postępowania w sprawach zastosowania środków tymczasowych oraz orzeczenia mające wpływ na prawa nieobecnych w postępowaniu osób trzecich. Sformułowane zostały ogólne wnioski oraz dokonano oceny ich zgodności ze standardami rzetelnego procesu określonymi w EKPCz i KPP.
