  Constitutional Court sentence of 16 November 2011 in case SK 45/09 is on one hand a continuation of the previous Polish Constitutional Court’s line of jurisprudence in the so-called EU issue, but on the other hand, it is also a breakthrough. Until then, the authority has not considered on the constitutionality of the EU secondary law. In this sentence Constitutional Court did not recognize unconstitutionality of the EU secondary law (and more specifically of the Council Regulation (EC) No 44/2001 of 22 December 2000), but stressed, just like Constitutional Courts of Italy and Germany, that the control over the constitutionality of EU secondary law is justified by the human rights protection. Thus, it defined itself as a "court of last word" in this area and confirmed the acceptability and legitimacy of scrutinizing EU secondary law in dealing with a constitutional complaint.;
  Nel decennio di appartenenza della Polonia all’Unione Europea (1 maggio 2014 è stato l’anniversario del nostro ingresso nelle strutture dell’Unione) la Corte costituzionale polacca (in seguito anche: CC) ha emesso alcune sentenze significative sulle questioni giuridico-costituzionali relative alle conseguenze dell’appartenenza all’Unione e soprattutto alla relazione tra il diritto nazionale e il diritto dell’Unione Europea. Anche la sentenza del 16 novembre 2011 che ho scelto per l’oggetto dell’analisi nel presente articolo appartiene al gruppo delle cosiddette “sentenze comunitarie” della CC e continua, come dimostrerò in seguito, l’attuale orientamento giurisprudenziale della Corte costituzionale.;
  Wyrok TK z 16 listopada 2011 r. w sprawie SK 45/09 jest z jednej strony kontynuacją dotychczasowej linii orzeczniczej polskiego sądu konstytucyjnego w tzw. kwestii unijnej, ale z drugiej strony jest też przełomowy. Dotychczas bowiem organ ten nie orzekał w sprawie konstytucyjności prawa pochodnego UE. W omawianym wyroku TK nie dopatrzył się wprawdzie niekonstytucyjności tego prawa (a konkretniej rozporządzenia Rady (WE) nr 44/2001 z dnia 22 grudnia 2000 r.), jednak podkreślił m.in., podobnie jak sądy konstytucyjne Włoch i Niemiec, iż kontrola konstytucyjności pochodnego prawa unijnego jest uzasadniona ochroną praw i wolności jednostki. Tym samym uznał się w tym obszarze za „sąd ostatniego słowa” i potwierdził dopuszczalność i zasadność kontroli unijnego prawa pochodnego w postępowaniu ze skargi konstytucyjnej.
