  The article compares the regulations concerning consent for donation of tissues, cells and organs in the case of ex mortuo transplantation. The comparison was made based on the opting in and opting out systems. The legal regulations in Poland, the USA and Spain were compared. In the USA and Spain, despite the existence of different consent systems for donation of organs, cells and tissues, the donor rates per million citizens are the highest. In Poland, the number of transplants is still low, and the problem is not limited to the public awareness. The legal regulations concerning donations affect the number of performed procedures. Legal regulations that raise doubts do not make it easier for potential donors to make a decision about what should happen to their body after death. The article indicates which regulations in the Polish Transplant Act raise doubts and what changes should be introduced to make it easier for potential donors to make a decision in this regard. This will increase the number of transplants.;
  W artykule porównane zostały przepisy dotyczące zgody na pobranie tkanek, komórek i narządów w przypadku transplantacji ex mortuo. Porównania dokonano na tle dwóch systemów – opting in i opting out, na podstawie regulacji obowiązujących w Polsce, USA i Hiszpanii. W Stanach Zjednoczonych i Hiszpanii mimo obowiązywania różnych systemów zgody na pobranie narządów, komórek i tkanek współczynniki dawców przypadających na milion mieszkańców danego kraju są najwyższe. W Polsce liczba transplantacji wciąż pozostaje na niskim poziomie, problem nie leży jednak tylko w świadomości społeczeństwa. Regulacje prawne w zakresie transplantacji również w dużej mierze przekładają się na liczbę przeprowadzanych zabiegów. Przepisy ustawy budzące wątpliwości nie ułatwiają potencjalnym dawcom podjęcia decyzji dotyczącej tego, co ma się stać z ich ciałem po śmierci. W artykule wskazano, jakie zapisy w polskiej ustawie transplantacyjnej budzą wątpliwości i jakie zmiany powinny zostać wprowadzone, aby ułatwić potencjalnym dawcom podjęcie decyzji w tym zakresie, co przełoży się na wzrost liczby transplantacji.
