The article presents the principles of postal operator’s liability for nonperformance or inadequate performance of postal services concerning the carriage of goods. The analysis of regulations of the Postal Law Act was made with reference to the Transport Law Act, which is the basic legal act concerning transport of goods in domestic traffic. The author indicates similarities and discrepancies between these regulations. In conclusion, the author states that it is necessary to strive for unification of the regulation concerning carrier’s and postal operator’s liability for damage in the transported goods.;
W artykule przedstawiono zasady odpowiedzialności operatora pocztowego za niewykonanie lub nienależyte wykonanie usług pocztowych polegających na przewozie przesyłek. Analiza regulacji ustawy Prawo pocztowe została dokonana na tle przepisów Prawa przewozowego, które jest podstawowym aktem prawnym dotyczącym przewozów rzeczy w obrocie krajowym. Autor wskazuje na podobieństwa oraz rozbieżności między tymi regulacjami. W konkluzji autor stwierdza, że należy dążyć do ujednolicenia regulacji dotyczącej odpowiedzialności przewoźnika i operatora pocztowego za szkody w przewożonych przesyłkach.
