  The subject of this publication is an analysis of the currently applicable regulations of the Act of March 2, 2020 on special solutions related to the prevention, counteraction and combating of COVID-19, other infectious diseases and crisis situations caused by them (i.e. Journal of Laws of 2021, item 2095, as amended, hereinafter: the covid act) and an indication of their shortcomings in the context of the implementation of the principle of open examination of administrative court cases. It follows from the overriding principles of administrative court proceedings that the trial should be open and the party should have the right to access the court, control the contested acts and actively participate in it. The right of an individual to a fair and public hearing of a case without undue delay, by a competent, independent, impartial and independent court has a constitutional dimension. The purpose of the principle of openness is to motivate the court to scrupulously and diligently fulfill procedural obligations and to enable third parties to exercise civic control over the activities of the courts. The authors of the article try to answer the question whether the hearing located in administrative courts and its substitute form, which is a closed session, meet the constitutional standards of open proceedings. An invaluable value for the party is its personal participation in the hearing and the possibility to freely present its position in the courtroom, directly in front of the court. This constitutes the exercise of the right to active participation in the procedure. The parties then have the opportunity to express their arguments, and this translates into a sense of treating them subjectively. The authors conclude that the legislator should explicitly define the formula for public access to remote hearing, or modify covid regulations in such a way that the court has the freedom to assess the situation allowing or not to conduct a hearing in the court building. Perhaps a greater range of options would allow for more appropriate solutions that would not violate the principle of open court proceedings and would not restrict the citizen's right to a court.;
  Przedmiotem niniejszej publikacji jest analiza obecnie obowiązujących regulacji ustawy z dnia 2 marca 2020 r. o szczególnych rozwiązaniach związanych z zapobieganiem, przeciwdziałaniem i zwalczaniem COVID-19, innych chorób zakaźnych oraz wywołanych nimi sytuacji kryzysowych (t. j. Dz. U. z 2021 r., poz. 2095 ze zm., dalej: ustawa covidowa) oraz wskazanie na ich niedostatki w kontekście realizacji zasady jawnego rozpatrywania spraw sądowoadministracyjnych. Z zasad naczelnych postępowania sądowoadministracyjnego wynika, że proces powinien być jawny, a strona powinna mieć prawo dostępu do sądu, kontroli zaskarżonych aktów oraz czynnego w nim udziału. Prawo jednostki do sprawiedliwego i jawnego rozpatrzenia sprawy bez nieuzasadnionej zwłoki, przez właściwy, niezależny, bezstronny i niezawisły sąd, ma wymiar konstytucyjny. Celem zasady jawności jest motywowanie sądu do skrupulatnego i rzetelnego wypełniania obowiązków procesowych oraz umożliwianie osobom postronnym sprawowanie obywatelskiej kontroli nad działalnością sądów. Autorzy w artykule próbują odpowiedzieć na pytanie, czy rozprawa odmiejscowiona w sądach administracyjnych oraz zastępcza jego forma, jaką jest posiedzenie niejawne, spełnia konstytucyjne standardy jawności postępowania. Wartością nieocenioną dla strony jest jej osobisty udział w rozprawie i możliwość swobodnego zaprezentowania swojego stanowiska na sali rozpraw, bezpośrednio przed sądem. To stanowi realizację prawa do aktywnego udziału w postępowaniu. Strony mają wówczas możliwość wypowiedzenia swoich racji, a to przekłada się na poczucie podmiotowego ich traktowania. Autorzy w konstatacji wskazują, że ustawodawca powinien wprost określić formułę dostępu publiczności do rozprawy zdalnej, ewentualnie zmodyfikować covidowe regulacje w ten sposób, by sąd miał swobodę w ocenie sytuacji pozwalającej lub nie, przeprowadzić rozprawę w budynku sądu. Być może większy wachlarz możliwości pozwoliłby na trafniejsze rozwiązania, które nie naruszałyby zasady jawności postępowania sądowego i nie ograniczałyby obywatelowi prawa do sądu.
