  The aim of this article is to present the legal and extralegal factors that determine the effectiveness of a legal norm. The subject of analysis is the legal obligation to wear medical masks, i.e., the mandate to cover the mouth and nose in public places. This requirement was in force in Poland during the COVID-19 pandemic from October 10, 2020, to March 28, 2022, and sparked considerable controversy among the public. Poles adopted various strategies and social attitudes towards this obligation, raising the need to answer the question of what factors underpinned the adoption of specific social strategies and how these attitudes influenced the effectiveness of the analyzed legal norm.Qualitative research in the form of in-depth interviews, supplemented by quantitative research conducted by CBOS, led to the conclusion that differences in adopted attitudes stemmed from varying hierarchies of values, different understandings of public health protection, diverse interpretations of the concepts of “common good” and “individual interest,” attitudes towards the government and the state as an institution, and, finally, different sensitivities to social pressure. It was also found that different attitudes towards mask-wearing influenced various dimensions of legal effectiveness-some were correlated with procedural effectiveness, while others were linked to the factual effectiveness of the norm.;
  Celem niniejszego artykułu jest przedstawienie prawnych i pozaprawnych czynników warunkujących skuteczność funkcjonowania normy prawnej. Przedmiotem analizy jest prawny obowiązek noszenia maseczek medycznych, czyli nakaz zakrywania ust i nosa w miejscach publicznych. Nakaz ten obowiązywał w Polsce w czasie pandemii COVID-19 od 10 października 2020 do 28 marca 2022 roku i wzbudzał wśród społeczeństwa wiele kontrowersji. Polacy przyjmowali wobec tego obowiązku rozmaite strategie i postawy społeczne, co zrodziło potrzebę odpowiedzi na pytanie jakie przesłanki leżały u podstaw przyjmowania poszczególnych strategii społecznych i w jaki sposób postawy te wpływały na skuteczność analizowanej normy prawnej. Przeprowadzone badania jakościowe w formie wywiadów pogłębionych, uzupełnione badaniami ilościowymi CBOS, pozwoliły wysnuć wniosek, że różnice w przyjmowanych postawach wynikały z różnej hierarchii wyznawanych wartości, odmiennego rozumienia kwestii ochrony zdrowia publicznego, różnej interpretacji pojęcia „dobra wspólnego” i „interesu indywidualnego”, stosunku do rządzących oraz państwa jako instytucji, wreszcie – różnej wrażliwości na presję otoczenia społecznego. Okazało się również, że różne postawy wobec noszenia maseczek oddziaływały na odmienne wymiary skuteczności prawa, to znaczy inne były skorelowane ze skutecznością proceduralną, inne ze skutecznością faktyczną normy.
