• Description:
  The aim of article is to present the normative analysis of Article 131 of the Constitution of the Republic of Poland regulating the issue of presidential substitution. This issue is extremely important from the point of view of the continuity of state power assessed primarily in the international field. Considerations concerning Article 131 of the Constitution are based on doctrinal views as well as on new, untouched regulations contained in the Act on the Organisation and Procedure of Proceedings before the Constitutional Tribunal. The concluding aspect of the article is a critical assessment of the regulations contained both in the above-mentioned Act and in the Constitution itself.;
  Celem opracowania jest przedstawienie analizy normatywnej art. 131 Konstytucji RP regulującego problematykę zastępstwa prezydenta RP. To zagadnienie jest niezwykle ważne z punktu widzenia ciągłości władzy państwowej ocenianej przede wszystkim na polu międzynarodowym. Rozważania dotyczące art. 131 Konstytucji oparte są zarówno na poglądach doktryny, jak i na nowych, nieporuszanych dotychczas, unormowaniach znajdujących się w ustawie o organizacji i trybie postępowania przed Trybunałem Konstytucyjnym. Aspektem podsumowującym artykuł jest krytyczna ocena uregulowań znajdujących się zarówno we wspomnianej ustawie, jak i w samej Konstytucji.
