The main topic of this article is the participation of the accused’s defense attorney in the proceedings before a medical court. The article points to practical problems resulting from rather scarce regulations, which cannot always be solved even by the proper application of the Code of Criminal Procedure. In particular, the discussion focuses on the possibility of acting as a defense attorney for attorney-at-law trainees, the concept of a doctor authorized to act as a defense attorney, defense secrecy and the issue of cassation proceedings. The article concludes with conclusions from the normative analysis and postulates, which, in the author’s opinion, are to solve the existing problems.;
Wyrażonego w Konstytucji RP prawa do obrony, w znaczeniu formalnym – tj. do korzystania z pomocy obrońcy, nie wolno zawężać jedynie postępowania karnego sensu stricto. Należy odnieść je również do innych postępowań represyjnych, w tym do postępowania w przedmiocie odpowiedzialności zawodowej lekarzy i lekarzy dentystów. Artykuł podejmuje więc problematykę udziału obrońcy w tym postępowaniu. Wskazuje na problemy praktyczne wynikające z dość skąpej regulacji, których nie zawsze można rozwiązać nawet przez odpowiednie zastosowanie Kodeksu postępowania karnego. W sposób szczególny rozważania poświęcone są możliwości występowania w charakterze obrońcy aplikantów adwokackich i radcowskich, pojęciu lekarza uprawnionego do działania w charakterze obrońcy, tajemnicy obrończej oraz problematyce postępowania kasacyjnego. Zwieńczeniem artykułu są wnioski z przeprowadzonej analizy normatywnej oraz postulaty de lege ferenda, które w opinii autora mają rozwiązać istniejące problemy.
