  As a result of the recent amendment to the Polish Labour Code the circle of persons entitled to parental rights has been broadened, which constitutes a considerable legislative change. Before the amendment the female employee could share the paternity leave only with the father raising a child who was an employee. Nowadays this rights has also the father raising a child who is insured. The principle of sharing of the paternity leave applies also to a situation, where the father bringing up his child is an employee and the mother who is ensured on the basis of the other title submits an application for maternity allowance for the period corresponding to the time of paternity leave in its full extent. The parental leave is optional. It may be used once in its entirety or be divided up into parts, but no more than four ones. Each part may only be used immediately one after the other and in the amount of a multiple of a week. However, there is an exception to this immediacy rule according to which the amount of the paternity leave in the amount of up to 16 weeks may be used at a later time. The amount of paternity leave of an employee who joins this leave with the performed work is prolonged proportionally to the time of work carried out by him or her during that time. The employee may use the paternal leave until his child has completed 24 months. The leave may be divided up into two parts, whereas each part should last one week. The leave for the purpose of child raising in the amount of up to 36 months can be awarded until the end of the calendar year in which the child completes six years. The persons entitled to use this leave are both parents or guardians of the child. In such a case the joint amount of the leave cannot exceed 36 months. The leave for the purpose of child raising is awarded in no more than 5 parts. During this leave the employee is allowed to take up work with his current employer or with the new one. They are also entitled to take up another earning activity, studies or training, as long as it does not prevent them from performing personal care of the child.;
  Istotną zmianą, którą wprowadziła ostatnia nowelizacja, jest powiększenie grona osób uprawnionych do korzystania z uprawnień rodzicielskich. Dotychczas pracownica mogła dzielić się urlopem rodzicielskim jedynie z pracownikiem – ojcem wychowującym dziecko. Obecnie takie uprawnienie ma także ubezpieczony – ojciec wychowujący dziecko. Zasada dzielenia obejmuje również sytuację, gdy to ojciec wychowujący dziecko jest pracownikiem, a matka ubezpieczona z innego tytułu złożyła wniosek o wypłatę zasiłku macierzyńskiego za okres odpowiadający okresowi urlopu rodzicielskiego w pełnym wymiarze. Urlop rodzicielski jest fakultatywny i może zostać wykorzystany jednorazowo albo w częściach – nie więcej niż czterech, bezpośrednio jedna po drugiej, w wymiarze wielokrotności tygodnia. Istnieje jednak wyjątek od zasady bezpośredniości – do 16 tygodni urlopu rodzicielskiego może być wykorzystane w późniejszym terminie. Wymiar urlopu rodzicielskiego pracownika, który łączy go z pracą, wydłuża się proporcjonalnie do wymiaru czasu pracy podjętej przez niego w tym czasie. Pracownik może wykorzystać urlop ojcowski do ukończenia przez dziecko 24. miesiąca życia. Urlop ten można podzielić na dwie części, z których każda powinna trwać tydzień. Urlop wychowawczy w wymiarze do 36 miesięcy, jest udzielany na okres nie dłuższy niż do zakończenia roku kalendarzowego, w którym dziecko kończy 6. rok życia. Z urlopu wychowawczego mogą jednocześnie korzystać oboje rodzice lub opiekunowie dziecka – wówczas łączny wymiar urlopu nie może przekraczać 36 miesięcy. Urlop rodzicielski udzielany jest nie więcej niż w 5 częściach. W czasie urlopu wychowawczego pracownik ma prawo podjąć pracę zarobkową u dotychczasowego pracodawcy lub innego pracodawcy albo inną działalność, a także naukę lub szkolenie, jeżeli nie wyłącza to możliwości sprawowania osobistej opieki nad dzieckiem.
