  Im Artikel wird die Rolle Zabarellas im Entstehungsprozess des Dekrets Haec sancta untersucht, das in einer Kurzfassung am 30. März und in einer Langfassung am 6. April 1415 in Konstanz dekretiert wurde. Während Zabarella die erste Version vor den versammelten Konzilsvätern verlas, weigerte er sich, diese Aufgabe im Falle der finalen Fassung zu übernehmen – und gab der Forschung damit Anlass zu einer breit geführten Debatte über seine Motive. Mittels des Vergleichs der zentralen Aussagen der beiden Textversionen von Haec sancta mit der juristischen Doktrin Zabarellas, wie er sie in den Jahren von 1402 bis 1408 in seinem Traktat De schismate niedergeschrieben hat, wird die Vereinbarkeit der Kurzfassung und die Diskrepanz der Langfassung mit der Rechtsauffassung des Kanonisten aufgezeigt. Hiervon ausgehend wird seine Weigerung erklärt, Haec sancta in der finalen Form zu verlesen. Gleichwohl kann aufgezeigt werden, dass Zabarella das Dekret auch in seiner finalen Fassung mitzutragen bereit war, wenngleich in distanzierter Weise, wie die Analyse seines Verhaltens in der betreffenden Konzilssitzung am 6. April zeigt.;
  The article examines Zabarella’s role in the developing process of the council decree Haec sancta. A short version of it was decreed in Constance on the 30th of March and a long version on the 6th of April in 1415. Although Zabarella read the first version to the gathered members of the council, he refused to do so when it came to the final version. His refusal provoked a controversial debate with regard to his motives. By comparing the central messages of both versions of Haec sancta with Zabarella’s juristic doctrine, which he put into writing in his tract De schismate from 1402 to 1408, two circumstances can be shown: the compatibility of the short version and Zabarella’s legal conception on the one hand, and the discrepancy between the long version and his conception on the other hand. Hence, his refusal to read out Haec sancta in its final form can be explained. Nevertheless, the analysis of Zabarella’s behaviour in the meeting of council on the 6th of April shows that he was willing to accept the decree even in its final stage – in a distanced manner, however.;
  W artykule przebadano rolę Zabarelli w procesie powstawania dekretu Haec sancta, który został uchwalony w Konstancji w formie skróconej 30 marca, w formie pełnej 6 kwietnia 1415 roku. Pierwsza wersję tego dokumentu przeczytał Zabarella przed zgromadzonymi uczestnikami soboru. Wzbraniał się jednak podjąć tego zadania w wypadku ostatecznej wersji tego dokumentu, dając tym samym nauce powód do szeroko prowadzonej debaty. Porównanie kluczowych orzeczeń w obu wersjach tekstu Haec sancta ze spisaną w latach 1402-1408 w traktacie De schismate doktyną prawniczą Zabarelli wykazało, że koncepcje prawne tego kanonisty zgodne są z pierwszą wersją Haec sancta, występuje natomiast rozdźwięk z ostatecznie ogłoszonym dekretem. W związku z tym fakt wzbranianie się przez Zabarellę przed odczytaniem Haec sancta w rozwiniętej formie jest zrozumiały. Jednocześnie można stwierdzić, że Zabarella gotowy był odpowiadać – w zdystansowany sposób – za ostateczną wersję dekretu, na co wskazuje analiza jego zachowania podczas posiedzenia soboru w dniu 6 kwietnia.
