The issue of testate succession in Lithuanian Statutes (1529, 1566 and 1588) has been the focus of many studies undertaken by Polish scholars in the last 200 years in an attempt to determine the influence of Roman law on Lithuanian statutes. It has been recently proposed (S. Godek) that those influences are already present in the First Statute in which some references to Justinian Law can be found. A comparison of Lithuanian Statutes with the 14th century Roman law coursebook Summa utrisque iuris written by Master Raymundus confirms the opinion that Roman influences on Lithuanian regulations originated directly from that work. Most of the borrowings show influences of a formal nature and can be seen in the structure of the regulation as well as the terminology used in the Latin translation of an authentic old Russian text listing a catalogue of persons deprived of the right to make a will, and those excluded from being witnesses when a will was made. Summa utrisque iuris was undoubtedly an impulse to codify the principles of testate succession. Another example is the reception of the Roma norm with regards the state of lucida intervalla. On the other hand, as Lithuanian courts practice before 1529 shows, in the case of the regulation of a change to the will for example, the Roman principles were not received. Apparently, Lithuanian codifiers were selective in adopting Roman solutions.;
Dans la science polonaise, la succession selon les Statuts de Lituanie (1529, 1566, 1588) est un objet de recherche depuis derniers deux cents ans. C'est la question de l'influence du droit romain sur le droit lituanien qui constitua l'impulsion principale a ce recherche. Dans ce sujet, les derniers travaux de Stanisław Godek montrent que cettes influences parurent deja dans le Statut Ier de 1529. Selon Mr Godek, dans le Statut Ier les fragments romains furent repris du droit justinien. La comparaison des prescriptions du droit lituanien avec un manuel du droit romain provenant du XIVe siecle, a savoir la Summa utriusque iuris du maitre Raymond, permets de constater que tous les emprunts du droit romain qu'on trouve dans le Statut Ier viennent de cet ouvrage. La majorite des emprunts du droit romain avaient le caractere purement formel et ils ne concernerent que la structure des prescriptions et la terminologie. Notamment cela concerne l'article du Statut qui prescrivit le catalogue des personnes privees du droit de tester ainsi que les personnes qui ne pourraient etre les temoins de testament. La Somme fut l'impulsion a codifier les regles de la succession testamentaire.. La reception est visible dans le cas concernat du droit de tester dans l'etat de lucida itervalla. Certainement, il n'y avait pas de la reception dans le cas du principe du changement de testament par le testateur. Cette constatation est confirmee aussi dans les sources de la pratique d'avant 1529. Il probable que les codificateurs du Statut Ier se referaient au droit romain dans la maniere selective. L'utilisation de la Summa du maitre Raymond dans le Statut Ier resulta de la popularite de cet ouvrage. On constate que la Somme fut connue dans certaines villes polonaises. Elle fut employee par Jan Cervus Tucholiensis, theoriciens du droit polonais de ville au XVIe siecle.  ;
Prawo spadkowe w Statutach litewskich stanowi temat już wielokrotnie podejmowany w polskim piśmiennictwie. Jego popularność wiąże się z poszukiwaniem w przepisach regulujących dziedziczenie testamentowe wpływów prawa rzymskiego, analizowanych przez plejadę polskich badaczy: Józefa Czackiego, Franciszka Morze, Ignacego Daniłowicza, Franciszka Bossowskiego, Rafała Taubenschlaga, Stanisława Ehrenkreutza, Karola Koranyiego oraz Juliusza Bardacha. Przed kilku laty Sławomir Godek wyczerpująco zreferował stan badań nad wpływami prawa rzymskiego w Królestwie Polskim i Wielkim Księstwie Litewskim, sam również poświęcił szereg prac zagadnieniu recepcji prawa justyniańskiego w trzech Statutach litewskich, zwłaszcza w zakresie prawa spadkowego oraz opiekuńczego. Przeprowadzone przez niego analizy dowiodły znacznych zbieżności regulacji prawa opiekuńczego i dziedziczenia testamentowego w kodyfikacji justyniańskiej i kodeksach litewskich. Potwierdził on ustalenia K. Koranyiego i F. Bossowskiego, że wpływ prawa rzymskiego można wiązać już z I Statutem litewskim, a nawiązując do ustaleń R. Taubenschlaga i J. Bardacha opowiedział się za bezpośrednią romanizacją z prawa justyniańskiego. Jak jednak sam zauważył we wstępie do swojej książki, przyjęta przez niego metoda porównywania tekstów Statutów z fragmentami kodyfikacji Justyniana stanowi jeden z etapów w badaniach źródłoznawczych nad pomnikami litewskimi i tym samym zagadnienie źródeł Statutów litewskich wciąż stanowi otwartą kwestię do dalszych poszukiwań.
