Przedmiotem glosowanego orzeczenia jest ustalenie charakteru prawnego terminu określonego w art. 129 ust. 4 u.p.o.ś. Przyjęcie tezy, iż termin ten jest terminem zawitym do wystąpienia z roszczeniem odszkodowawczym prowadzi do wniosku, iż roszczenie to przedawnia się w ogólnym terminie - 10 lat. Glosowane orzeczenie potwierdza przyjetą przez Sąd Najwyższy linie orzeczniczą, stabilizując poglądy dotyczące trybu dochodzenia roszczen odszkodwawczych wynikajacych z wyznaczenia obszarów ograniczonego użytkowania.
